Owner Verification. Sampling and testing performed to validate the quality of the product. The sampling and testing are to be performed by qualified testing personnel employed by ADOT or its designated agent, excluding the Contractor.
Owner Verification. The ENGINEER shall conduct Owner Verification (OV) to verify Developer’s or DB Contractor’s compliance with all testing frequencies and requirements, including performance and acceptance testing, set forth in the CDA, FCA, PTA or DBA, and Developer’s or DB Contractor’s approved MP, and the approved QAP. The ENGINEER’s OV effort during construction shall focus on materials, components, systems and elements where nonconforming work, deviations, defects or other non- compliance could affect safety, compliance with governmental approvals or the residual life at handback. The ENGINEER shall perform OV as the express agent of STATE, under STATE’s exclusive direction and control, and STATE will pay for all costs of the ENGINEER’s OV services. The ENGINEER shall recommend scope and timing of additional monitoring, audit or independent inspection and quality control measures to be undertaken by either STATE or the ENGINEER OV is the construction inspection and sampling and testing performed by the ENGINEER on behalf of STATE to verify contract compliance with the plans and specifications through construction inspections and statistical comparison and validation of the results of tests and construction undertaken by Developer or DB Contractor as part of the Developer’s or DB Contractor’s Quality Control and Quality Assurance approved procedures, and the approved QAP as a whole. Under the CDA, FCA, PTA or DBA, Developer or DB Contractor is obligated to implement a Quality Assurance and Quality Control program which is to be described in Developer’s or DB Contractor’s MP. The principal parts of the MP will be a pre-execution deliverable, subject to STATE’s reasonable approval. Substantial parts of the MP will be in place before appointment of the ENGINEER. After appointment the ENGINEER shall, as one of its Baseline Duties, provide independent reports to STATE to recommend acceptance or otherwise of Developer’s or DB Contractor’s additions and amendments to the MP. All independent assurance samples and tests or other procedures comprising OV shall be performed by ENGINEER’s laboratories that are accredited by the AASHTO Materials Reference Laboratory (AMRL) or a comparable laboratory accreditation program approved by STATE.
