Non-Compliance and Enforcement. The Company shall report to the Village and, as appropriate, other Governmental Authorities, immediately upon obtaining knowledge thereof, all violations of the terms and conditions of any Governmental Approval or Applicable Law pertaining to the Project. The Village shall have the right to independently enforce compliance with this Agreement regarding the requirements of any Governmental Approval regardless of whether a concurrent or different regulatory enforcement action has been undertaken by any other Governmental Authority.
Non-Compliance and Enforcement. The Design-Builder shall report to the Owner and, as appropriate, other Governmental Bodies, immediately upon obtaining knowledge thereof, all violations of the terms and conditions of any Governmental Approval, Environmental Mitigation Measures or Applicable Law pertaining to the Design-Build Improvements. Any unexcused non-compliance with regulatory standards imposed by Applicable Law shall constitute a breach of this Design-Build Agreement and may be enforced as such by the Owner irrespective of any regulatory enforcement inaction or action by any Governmental Body.

The Company shall report immediately to the County any inspections by any governmental agencies known to the Company and all violations of the terms and conditions of any Governmental Approval or Applicable Law pertaining to the Managed Assets. The County shall have the right independently to enforce compliance with the requirements of any Governmental Approval regardless of whether a concurrent or different regulatory enforcement action has been undertaken by any other Governmental Body. The material failure of the Company to comply with any Governmental Approval shall constitute a breach of this Agreement as well as an event of noncompliance with the Governmental Approval.
Non-Compliance and Enforcement. Except as provided in Section 7.1, the Company is responsible for complying with the terms and conditions of all Governmental Approvals. The Company shall report immediately to the County any inspections by any Governmental Bodies and all violations of the terms and conditions of any Governmental Approval or Applicable Law pertaining to the Transfer Station and Drop- Box Sites. The County shall have the right independently to enforce compliance with this Contract regarding the requirements of any Governmental Approval regardless of whether a concurrent or different regulatory enforcement action has been undertaken by any other Governmental Body. The failure of the Company to comply with any Governmental Approval shall constitute a breach of this Contract as well as an event of noncompliance with the Governmental Approval.

The DBOM Contractor shall report to the BWS, immediately upon obtaining knowledge thereof, all violations or potential violations of the terms and conditions of any Governmental Approval or Applicable Law pertaining to the Project. The BWS shall have the right independently to enforce compliance with the requirements of any Governmental Approval regardless of whether a concurrent or different regulatory enforcement action has been undertaken by any other Governmental Body. In the event that the DBOM Contractor or any Subcontractor fails at any time to comply with Applicable Law (including any Governmental Approval) it shall take all actions required by subsection 4.4(E) (Fines, Penalties and Remediation), including immediately correcting such failure and resuming compliance with Applicable Law.

Operator shall report to Administrator and PREB, in writing, as soon as possible upon obtaining knowledge thereof (but in no event more than forty-eight (48) hours (or such shorter period within which notice is required to be given to a Governmental Body under Applicable Law) after obtaining such knowledge), all violations of the terms and conditions of any Governmental Approval.

The Company shall report to the Borough, expeditiously upon obtaining knowledge thereof, all violations of the terms and conditions of any Governm ental Approval or Applicable Law pertaining to the Managed Assets or the Collection System. The Borough shall have the right indepen dently to enforce compliance with the requirem ents of any Governmental Approval regardless of whether a concurrent or different regulatory enforcemen t action has been undertaken by any other G overnm ental Body. Unless excused by Uncontrollable Circumstances, the failure of the Company to comply with any Governmental Approval shall constitute a breach of this Service Contract as well as an event of noncomplian ce w ith the Governm ental Approval.
