Incorporation of Contract Documents. The Design/Builder shall enter into Subcontracts with various Subcontractors for portions of the Work to be delegated by the Design/Builder. The Subcontracts shall require each Subcontractor, to the extent of the Work to be performed by such Subcontractor, to assume towards the Design/Builder all the obligations and responsibilities which Design/Builder assumes towards the Owner. All Subcontracts shall incorporate the terms of this Agreement and the Contract Documents to the extent applicable to the Work to be performed by the Subcontractor.

Incorporation of Contract Documents. The Contractor must incorporate the Contract Documents in each contract with a subcontractor engaged in the performance of the Work and require that all subcontractors comply with the terms of this Contract including but not limited to Insurance and Indemnity requirements. The Contractor shall be solely responsible for any delay or additional costs incurred as a result of its failure to provide adequate or accurate project information to a subcontractor that results in improper submittals and/or work, or time or other impacts is the sole responsibility of the Contractor. The Contractor will have all of the obligations and the Agency will have all of the remedies that are specified in Section 11.
Incorporation of Contract Documents. This Contract includes all Contract Documents (Legal Notice, RFB, Bid, Bidder’s submittal) and all forms, attachments, appendixes, and/or exhibits to this Contract and those documents. The Owner- Contractor Agreement is available for Subcontractor’s review at Contractor’s corporate office, and Subcontractor agrees that it has reviewed and/or had the opportunity to review the Owner- Contractor Agreement.

Incorporation of Contract Documents. All of the foregoing Contract Documents are incorporated herein by reference and made a part of this Agreement as if they were set out verbatim. To the extent there is a conflict between the terms of any of the documents that constitute this Agreement, the terms that provide the greater benefit to the City and/or impose the greater obligation on Gobis shall control.

The Contract Documents are by this reference specifically incorporated into and made a part of this Agreement.
