EQUIPMENT, FIXTURES AND SIGNS. Licensee agrees to use in the operation of each Licensee Tully’s Store equipment, fixtures, and furniture that are materially consistent with Licensor’s Standard Specifications with due consideration for the Local Regulations and Conditions. Licensee further agrees to place or display at the premises of each Store (interior and exterior) only such signs, emblems, logos, lettering, and display materials that are consistent with Licensor’s Standard Specifications. Licensee agrees to purchase all equipment, fixtures, furniture and signs (“Store Furnishings”) used in connection with the operation of Tully’s Stores from Licensor provided that the price, applicable taxes, delivery cost to the applicable store, and other terms for such purchases from Licensor shall be competitive with the price, applicable taxes, delivery cost to the applicable store, and other terms Licensee can obtain such items from other sources. In the event Licensor’s price and terms for such items are not competitive with other sources with respect to any proposed purchase of such items, Licensee shall be entitled to purchase such items from other sources. In the event Licensor fails to respond to any request from Licensee for prices and terms with respect to any purchase of Store Furnishings within fourteen calendar days, Licensee shall then have the right to immediately purchase such items from other sources.

EQUIPMENT, FIXTURES AND SIGNS. (a) All improvements, equipment or other property attached to or otherwise brought onto the Premises shall at all times be the personal property of Tenant and/or its subtenants and licensees. Tenant or its customers shall have the right to erect, install, maintain, and operate on the Premises such equipment, structures, fixtures, signs, and personal property as Tenant may deem necessary or appropriate, and such property, including the equipment, structures, fixtures, signs, and personal property currently on the Premises, shall not be deemed to be part of the Premises, but shall remain the property of Tenant or its customers. At any time during the term of this Lease Agreement and within a reasonable time after termination hereof, Tenant or its customers shall have the right, but not the obligation, to remove their equipment, structures, fixtures, signs, and personal property from the Premises.
EQUIPMENT, FIXTURES AND SIGNS. Tenant shall have the right, at Tenant's sole cost and expense to place, erect, install, maintain and operate on the Leased Premises, such equipment, fixtures, signs, awnings, advertising matter or other thing of any kind which Tenant may reasonably require for the purposes of its business so long as the same are not in violation of any existing laws, ordinances or governmental regulations. Upon termination or expiration of the Lease, any equipment, fixtures, signs, awnings advertising matter or other thing placed upon the Leased Premises by Tenant may be removed by Tenant at its sole cost and expense. In such event, Tenant shall repair any damage caused by such removal and shall restore the site to the same condition existing at the commencement of this Lease.
EQUIPMENT, FIXTURES AND SIGNS. Lessee shall have the right to erect, install, maintain and operate on the Leased Premises such equipment, trade and business fixtures, and other personal property as Lessee may deem necessary or appropriate. Any such installations shall not materially injure or deface the Improvements. Lessee shall repair, at its sole cost and expense, any damage to the Leased Premises resulting from the removal of such personal property.

A partial list of fixtures retained by the Landowner is attached as Attachment A. Installed items belonging to Tenant are included as Attachment B.

During the Term, Tenant and its customers have the right to remove the Tenant Facilities, or any portion thereof, without Landlord’s consent, at Tenant’s sole expense, and Tenant shall repair any damage to the Premises and the Property caused by such removal, subject to any and all applicable zoning, set-back, permitting, and or licensing requirements. Notwithstanding the foregoing, upon the expiration or earlier termination of this Agreement, Tenant shall be required to comply with the terms of Section 10 of this Agreement.

EQUIPMENT, FIXTURES AND SIGNS. Lessee shall have the right to erect, install, maintain and operate on the Premises such equipment, fixtures and signs as Lessee may deem advisable, including a rooftop satellite dish, subject to all applicable laws, rules and regulations, the Permitted Exceptions and the terms of this Lease. It is understood that any work of any kind made and done under this Section 8 shall be made and done at Lessee’s sole cost, and Lessee agrees to indemnify, defend and hold Lessor harmless from any and all mechanics’ liens that may be filed by reason thereof, as well as all claims, damages, costs, expenses and other liabilities associated therewith (including reasonable attorneysfees and costs).

Licensee may purchase equipment, fixtures, furniture and signs (“Store Furnishings”) used in connection with the operation of Tully’s Stores from Licensor or from other sources, when such sources are more competitive with respect to price, applicable taxes, delivery costs and other terms; provided, however, that all such Store Furnishings obtained from other sources are consistent with Tully’s brand concept and image of high quality.
