Equipment and Fixtures. Goods used or bought for use primarily in the Business (as defined in the Asset Purchase Agreement), whether or not an interest therein arises under real property law, now owned or hereafter acquired by the Buyer in relation to the Business;

Equipment and Fixtures. All equipment of every type and description owned by the Company, including (without limitation) all present and future machinery, furniture, fixtures, manufacturing equipment, shop equipment, office and recordkeeping equipment, parts, tools, supplies and other goods (except inventory) used or bought for use by the Company for any business or enterprise and including all goods that are or may be attached or affixed to or otherwise become fixtures upon any real property.
Equipment and Fixtures. CONTRACTOR shall provide new or in like new condition ATMs at the COUNTY designated locations (Operating Area) in Terminals A, B, and C. The Operating Area locations are shown on Exhibit 1 attached hereto. In total, CONTRACTOR shall provide six (6) ATMs. Locations are subject to COUNTY final approval. COUNTY may direct CONTRACTOR to relocate and/or remove ATMs. CONTRACTOR is responsible for compliance with all applicable ADA requirements for ATMs. The 2013 Building Code shall apply. CONTRACTOR shall provide all utility infrastructures necessary to operate the ATMs. CONTRACTOR shall develop and submit to COUNTY for review and approval detailed plans and specifications for the installation of the ATMs within thirty (30) days from the execution of this CONTRACT. CONTRACTOR shall phase in the installation of the new ATMs so as to ensure COUNTY customers have uninterrupted access to ATM service during the installation process. CONTRACTOR shall pay for all installation, removal and relocation costs. All ATM equipment installed by CONTRACTOR shall remain the property of CONTRACTOR and CONTRACTOR shall bear all risk of loss or damage. At termination of this CONTRACT, CONTRACTOR shall, at its expense, remove all ATMs and restore the premises to the preexisting condition. The ATM design is subject to approval of COUNTY prior to installation. No display advertising of any type shall be permitted on or about the ATMs without the prior approval of COUNTY.
Equipment and Fixtures. Owner and Tenant agree that the premises contains the following mechanical systems: specialized HVAC system to include two (2) twenty (20) ton Liebert floor mounted air conditioning units and associated piping; specialized fire protection system consisting of a halon system and hydraulic preaction valve; and a domestic water backup system for the HVAC units. These systems are to be considered fixtures which Tenant shall take possession of and have the right to use. Tenant shall be responsible for maintaining the systems and preserving their functionality through out their normal life cycle. Should any of the components of these systems fail and require replacement, Tenant shall at its option and its expense, replace necessary components or restructure the system to eliminate the unwanted component in a manner approved by the Building Engineer. If Tenant elects to replace components at substantial capital cost, it shall have the option to designate such components as trade fixtures which Tenant will then be entitled to remove upon expiration of this Lease and vacation of the Premises.

Equipment and Fixtures. The Borrower, at its expense, shall cause the Equipment and Fixtures to be maintained and preserved in substantially the same condition, repair and working order as when new, ordinary wear and tear excepted. Notwithstanding the foregoing sentence, the Borrower shall not be required to maintain and repair Equipment and Fixtures to the extent that they are either obsolete or the cost of maintaining them exceeds their fair market value. In the case of any loss or damage to any of the Equipment or Fixtures, the Borrower shall, as promptly as practicable after the occurrence thereof, make or cause to be made all repairs, replacements and other
Equipment and Fixtures. Tenant shall have the right to erect, install, maintain and operate on the Leased Premises such equipment, trade and business fixtures, and other personal property as Tenant may deem necessary or appropriate, and such shall not be deemed to be part of the Leased Premises, but shall remain the property of Tenant, as provided in Section 2.11 above. Any such installations shall not materially injure or deface the Improvements. At any time during the Lease Term and within thirty (30) days after termination hereof, Tenant shall have the right to remove its equipment, fixtures, signs and other personal property from the Leased Premises provided that Tenant is not then in default. Tenant's Personal Property may be removed at the expiration or earlier termination of this Lease if Tenant repairs any damage to the Improvements caused by such removal and the removal does not affect or in any way weaken the structural integrity of the Improvements; provided that such repair shall not be required and the structural integrity of the Improvements may be affected or weakened, if Landlord requires that the Improvements be removed from the Land, and if Tenant removes the Improvements pursuant to Section 2.11 above. The foregoing provisions of this Section 13.1 are subject to Landlord's security interest in Tenant's "FF&E," as provided in Article 31 below; provided that nothing herein shall be deemed to limit Tenant's right to dispose of items of Tenant's Personal Property in the ordinary course of Tenant's business, so long as Tenant maintains Personal Property which is at all times sufficient for the operation of the Improvements.
Equipment and Fixtures. All equipment, furniture, fixtures, signs, motor vehicles and other personal property related to or used in connection with the Business or located on the Site, including, without limitation, the assets set forth on the attached Schedule 2.1(a).
