Design without Construction Phase Services. A. Engineer shall be responsible only for those Construction Phase services expressly required of Engineer in Exhibit A, Paragraph A1.05. With the exception of such expressly required services, Engineer shall have no design, Shop Drawing review, or other obligations during construction, and Owner assumes all responsibility for the application and interpretation of the Construction Contract Documents, review and response to Contractor claims, Construction Contract administration, processing of Change Orders and submittals, revisions to the Construction Contract Documents during construction, construction observation and review, review of Contractor’s payment applications, and all other necessary Construction Phase administrative, engineering, and professional services. Owner waives all claims against the Engineer that may be connected in any way to Construction Phase administrative, engineering, or professional services except for those services that are expressly required of Engineer in Exhibit A.

If Engineer is not retained for construction observation and/or on-site resident observation services, Engineer shall have no design, shop drawing review, or other obligations during construction, and Owner assumes all responsibility for the application and interpretation of construction contract documents, review and response to contractor claims, construction contract administration, processing of change orders and submittals, revisions to the construction contract documents during construction, construction observation and review, review of contractor’s payment applications, and all other necessary construction phase administrative, engineering, and professional services. Owner waives all claims against the Engineer that may be connected in any way to construction phase administrative, engineering, or professional services.

It is understood and agreed that if Engineer’s Services under this Agreement do not include Project observation, review of Contractor’s performance, or any other construction phase services, and that such services will be provided by PCCA, then PCCA assumes responsibility for interpretation of the Construction Contract Documents and for construction observation or review except where such interpretation is attributable to the design are an obvious design error or omission and requires correction by the Engineer of record.

Design without Construction Phase Services. 6.5.1.If the Owner requests in writing that Garver provide any specific construction phase services or assistance with resolving disputes or other subcontractor related issues, and if Garver agrees to provide such services, then Garver shall be compensated for the services as an Amendment in accordance with Sections 4 and 10.2.

Client waives all claims against the Consultant that may be connected in any way to construction phase services except for those Services that are expressly required in Consultants Scope of Services.

Should OWNER provide Construction Phase services with either OWNER’s representatives or a third party, ENGINEER’s Basic Services under this Agreement will be considered to be completed upon completion of the Final Design Phase or Bidding or Negotiating Phase as outlined in Exhibit A.

It is understood and agreed that if K&W's Basic Services do not include project observation, or review of a Contractor's performance, or any other Construction Phase services, and that such services will be provided by Client or others, then Client assumes all responsibility for interpretation of the Contract Documents and for construction observation or review and waives any claims against K&W that may be in any way connected thereto. In such a case, K&W's Basic Services under this Agreement will be considered to be completed upon completion of the Final Design Phase or Bidding or Negotiating Phase.
