Design and Construction of Facilities. The DEVELOPER at its own cost and expense shall cause to be designed, constructed and installed all of the necessary water and/or sewer facilities provided for in this Agreement unless otherwise specified. The facilities shall include any and all water mains, valves, fittings, fire hydrants, firelines, service connections, service lines, shutoffs, meter boxes, air release valves, gravity sewer mains, laterals, manholes, and all appurtenances thereto for a complete installation. The final design and construction of the facilities shall meet the requirements set forth in the latest revision of the DEPARTMENT'S "Rules and Regulations" for water and/or sewer service, shall be in accordance with the latest revision of the DEPARTMENT’S "Design and Construction Standard Specifications and Details", and shall be subject to approval by the DEPARTMENT.

Design and Construction of Facilities. As a condition of receiving wastewater service from TOWN, COMMUNITY shall perform or cause to be performed the design, permitting and installation of a sewer force main line consisting of approximately ( ) linear feet of 4 inch diameter pipe, and the Collection and Transmission Facilities as more specifically shown in Exhibit “B” attached to and incorporated herein by reference. The COMMUNITY shall also install a single submerged magnetic flow meter capable of measuring wastewater flow to be conveyed to the Town at a point specified by the Town. The Collection and Transmission Facilities shall be designed, constructed and installed pursuant to utility standards identified in the TOWN’s rules, regulations, resolutions, ordinances, manuals of practice, land development code, and TOWN approved plans.

Demonstration shall be in an IOU electric service territory and at a site that is an IOU customer. Each of the several parts of the material is to be of the maker’s standard design provided that this design is in general accordance with the specification. The essence of design should be simplicity and reliability in order to give long continuous service with high economy and low maintenance cost. Particular attention should be paid to internal and external access in order to facilitate inspection, cleaning and maintenance. The design dimensions and materials of all parts are to be such that they will not suffer damage as a result of stresses under the most severe conditions. Fully detailed specifications of the several parts of the material are to be submitted describing particularly the materials to be used. The materials used in the construction of the material are to be of the highest quality and selected particularly to meet the duties required of them. Mechanisms are to be constructed to avoid sticking due to rust or corrosion. Workmanship and general finish are to be of the highest class throughout. All similar parts of the material are to be interchangeable. All equipment is to operate without undue vibration and with the least possible amount of noise and is not to cause a nuisance. All equipment is to be designed to minimize the risk of fire and any damage, which may be caused in the event of fire. The equipment is also to be designed to prevent ingress of all vermin, accidental contact with live parts and to minimize the ingress of dust and dirt. The use of materials, which may be liable to attack by termites or other insects, is to be avoided.
