Cover photo: Fishermen mend their nets along a beach in Ghana (CREDIT: SFMP) BACKGROUND The United States Agency for International Development (USAID) has committed approximately US $24 million dollars to the implementation of the USAID/Ghana Sustainable Fisheries Management Project (SFMP). The objective of this five-year project (October 2014-October 2019) is to rebuild marine fisheries stocks and catches through adoption of responsible fishing practices. The project contributes to USAID’s Feed the Future (FtF) food security, climate change and biodiversity goals. The ultimate objective of the SFMP is to ensure that there are more fish in the waters of Ghana five years hence than there are today, that the appropriate measures are in place to sustain healthy and robust fisheries, and that all stakeholders are committed to the enduring health of Ghana’s fisheries and the people whose survival relies on it. SFMP will contribute to and help advance the work of the Government of Ghana’s Fisheries Commission (FC), Ministry of Fisheries and Aquaculture Development (MOFAD) and the West African Regional Fisheries Program (WARFP). Priority focus of this project are the small pelagic fish stocks, the most important stocks for food security in Ghana and which support 100,000 canoe fishers and 20,000 fish mongers and processers. Small pelagic fish stocks are at near collapse with annual yields down from record highs of approximately 130,000 MT 10 years ago to approximately 30,000 MT now. The cause of this decline is fleet overcapacity resulting in overfishing, poor governance and the open-access nature of the fishery. Authority/Disclaimer. The Authority's adoption of a non-smoking living environment, and the efforts to designate portions of its developments as non-smoking does not in any way change the standard of care that the Authority has under applicable law to render its developments any safer, more habitable or improved in terms of air quality standards than any other rental premises. The Authority specifically disclaims any implied or express warranties that the air quality in the apartment or the building containing the apartment will improve or be any better than any other rental property. The Authority cannot and does not warranty or promise that its developments will be free from secondhand smoke. The Authority’s adoption of the Smoke-Free Housing Policy does not in any way change the standard of care that it has to the Tenant’s apartments and the common spaces.
Authority/Disclaimer. The contractor and the materials, supplies and equipment to be used in connection therewith have been selected by the Borrower. The Authority and Escrow Agent shall have no responsibility for completion of the Improvements or the cost thereof, satisfactory performance by the contractor or any other matters related to the Improvements, the Authority's sole inter est in the foregoing being the suitability of the Improvements as security for the Loan and compliance with the terms and conditions herein contained. Any inspections performed hereunder are for the sole benefit of the Authority. This Agreement shall not be construed as conferring any rights or benefits on any third party.

Except to the extent prohibited by applicable law, JCI’s sole obligation and your sole and exclusive remedy for breach of the foregoing warranty shall be that JCI will use commercially reasonable efforts to correct the non-conforming Service functionality without charge. JCI shall not be liable for warranty nonconformance caused by use or combination with hardware and software not provided by JCI, misuse of the Service, or your negligence or willful misconduct. Unless otherwise expressly stated in the Agreement, this SONIFI Limited Warranty sets forth Company’s sole and exclusive remedies in the event of a breach of warranty herein during the Limited Warranty Period.

  • Legal Disclaimer The Corpus is granted without any warranty. Licensor shall not be held responsible for any damage (physical, financial or otherwise) caused by the use of the Corpus. Licensor shall not be held responsible of any illegal or criminal use of the Corpus by the End User.

  • Disclaimer of Agency 5.14.1 Except for provisions herein expressly authorizing a Party to act for another, nothing in this Agreement shall constitute a Party as a legal representative or agent of the other Party, nor shall a Party have the right or authority to assume, create or incur any liability or any obligation of any kind, express or implied, against or in the name or on behalf of the other Party unless otherwise expressly permitted by such other Party. Except as otherwise expressly provided in this Agreement, no Party undertakes to perform any obligation of the other Party whether regulatory or contractual, or to assume any responsibility for the management of the other Party's business.

  • Governing Law, Regulatory Authority, and Rules The validity, interpretation and enforcement of this Agreement and each of its provisions shall be governed by the laws of the state of New York, without regard to its conflicts of law principles. This Agreement is subject to all Applicable Laws and Regulations. Each Party expressly reserves the right to seek changes in, appeal, or otherwise contest any laws, orders, or regulations of a Governmental Authority.

  • Warranty and Warranty Disclaimer 3.1. IFS warrants that the Application Software will perform substantially as described in the Software Documentation for a period of six (6) months from the original license start date specified in the Notification Form (“Warranty Period”). No separate or extended Warranty Period shall apply with respect to any remedy of Errors or the purchase by Customer of any additional quantities and/or licenses of the Application Software or delivery by IFS of any additional copies. Any warranty claim must be made by Customer within the Warranty Period. IFS do not warrant that the Software will be constantly available, uninterrupted or error free or that all errors may be found to enable correction.

  • Authority and Purpose 1. It is the intent of the State and the Union to maintain a drug and alcohol free workplace. This objective is accomplished through education, employee assistance, reasonable suspicion and random drug and alcohol testing, and discipline. Consistent with a Peace Officer’s sworn oath to uphold the laws of the State of California, each Bargaining Unit 6 Peace Officer employee shall not illegally use or be impaired from the use of a drug designated in subsection B.2 (1) through (9), or be impaired by use of alcohol while on the job.
