Xxxxxx Software definition

Xxxxxx Software means Xxxxxx proprietary computer software programs, firmware, and third party software, in machine readable object code form only, intended to be used solely on and with the Xxxxxx Equipment supplied or designated by Xxxxxx xxxxxxxxx, and includes any Enhancements provided by Xxxxxx to Customer pursuant to the terms of this Agreement.
Xxxxxx Software means that certain server software described in Section 1 of Exhibit A attached hereto. Xxxxxx Software includes any Updates, Upgrades or New Versions of the foregoing released by PalmSource, in its sole discretion, during the term of this Agreement.
Xxxxxx Software shall not include any software licensed by Xxxxxx from third parties. Xxxxxx assumes no obligation or liability for any claim or action arising from or relating to such software. This paragraph IV A states the entire liability and obligation of Xxxxxx and Licensee and the exclusive remedy of Licensee and its sublicensees with respect to any actions or claims (i) of alleged infringement relating to or arising out of the subject matter of this Agreement or (ii) otherwise described in this paragraph IV A.

More Definitions of Xxxxxx Software

Xxxxxx Software means the specific items of software provided by X. Xxxxxx Computer Corporation only to the extent Customer; (i) has been provided pricing for that specific item of Xxxxxx Software; and (ii) is current in its payments for that specific item of Xxxxxx Software.
Xxxxxx Software shall have the meaning set forth in Section 7.08.
Xxxxxx Software means all electronic data processing systems, information systems, computer software programs, program specifications, charts, procedures, source codes, object codes, input data, routines, data bases and report layouts and formats, record file layouts, diagrams, functional specifications and narrative descriptions, flow charts and other related material and documentation and any and all licenses and copies thereof and rights thereto which is proprietary to Xxxxxx or material to the operation of its business (other than licenses of software that is generally commercially available).
Xxxxxx Software refers to software provided by X. Xxxxxx Computer Corporation to City as part of this Project, which includes the MeterSense Meter Data Management System (MDMS), the SmartWorks Compass Software, and the CustomerConnect customer portal. The Xxxxxx Software includes Software Licenses, Xxxxxx Software Updates or Upgrades to the MeterSense MDMS core software, SmartWorks Compass software, CustomerConnect software or MeterSense add-on modules.
Xxxxxx Software means Xxxxxx’x proprietary JobsEQ® workforce and economic management software, modeling tools, and all datasets included therein.
Xxxxxx Software means any and all software developed and provided to Red Hat by Xxxxxx pursuant to this Agreement.
