Unoccupied Building definition
Unoccupied Building means, for the purposes of this By-law, any building that is not occupied by the owner or tenant under a tenancy agreement and has been accessed by unwanted persons, but does not meet the definition of a vacant building, and may include a newly or partially constructed building that is or appears to be actively used for a legitimate purpose or appears dormant or abandoned.
Unoccupied Building means a building or portion thereof which lacks the habitual presence of human beings who have a legal right to be on the premises, including buildings ordered vacated by the village pursuant to authority granted by the Municipal Code or other laws and ordinances. The village may consider these factors when determining if a building is unoccupied:
Unoccupied Building means any building or structure which is or appears to an Officer to be abandoned, vacant, partially vacant, or unoccupied.
