Pedestrian Easement definition

Pedestrian Easement means and refer to the specific rights, privileges and easements which are established on the Land by Landlord or on individual Building Sites by Landlord or the Tenant thereof subsequent to approval pursuant to Section 6.3 hereof by the recording of a Declaration of Easement in the records of the Clerk and Recorder of Bernalillo County, New Mexico. If required by the Architectural Review Committee, with respect to an individual Building Site, a submittal of the Declaration of Easement to the Architectural Review Committee by the Tenant shall be mandatory prior to the time of Site Plan approval by the Architectural Review Committee in accordance with the provisions of Section 6.3 hereof. All such rights, privileges and easements shall be for the benefit of the Landlord, all other Tenants and the Land. Such rights, privileges and easements shall be a nonexclusive easement over and across the designated portions of the Building Site or the Land for the purpose of permitting the passage and accommodations of pedestrians;
Pedestrian Easement means an easement for pedestrian access as well as any potential utility crossing over the Pedestrian over the Pedestrian Crossing;

Examples of Pedestrian Easement in a sentence

  • Buyer acknowledges that the CITY is reserving a permanent Signage and Landscape Easement and a permanent Pedestrian Easement with the sale of the Property.

  • The portion of Parcel 1 burdened by Pedestrian Easement No. 1 is shown on Exhibit J and legally described in Exhibit L, attached hereto and hereby incorporated herein.

  • The Grantee shall be responsible for all maintenance and repairs of the 10-foot Wide Pedestrian Easement and the Pedestrian Easement – Land Retained, and, at the Grantor’s request, shall construct at both ends of the trail signage regarding rules for use and/or barriers to discourage motorized access and other uses that unreasonably disturb soils, wetland areas, plants or wildlife habitat or the quiet use and enjoyment of the Grantor's Property by the Grantor.

  • Any fill, excavation or other activities by the Grantee within the 10-foot Wide Pedestrian Easement and the Pedestrian Easement – Land Retained shall not materially alter the existing land contours and drainage characteristics within the Easement Area or elsewhere on the Grantor's Property.

  • As set forth therein, neither Grantor nor Grantee shall assume or have a duty of care to keep the Pedestrian Easement safe for entry or use by others for the recreational activities permitted hereunder, or to give warning to persons entering for such purposes of any hazardous condition, use, structure or activity on the property of Grantor, or to assume or incur liability for any injury or harm to person to property caused by any act of other persons.

  • Purchaser agrees that the Encroachment Agreement and "Pedestrian Easement" shall be Permitted Exceptions for all purposes hereunder.

  • Grantor, or its successor in interest, shall be responsible for all maintenance work conducted in the Pedestrian Easement area and at the completion of such work shall restore any disturbed areas to substantially the same condition, or as close thereto as is reasonable possible, all at no cost to Grantee.

  • An easement, for use by the public, of a certain area generally enumerated and to be identified as the “City Pedestrian Easement Area” on the concept plan attached hereto as Exhibit A;, the area to be further determined during the Master Planning process.

Related to Pedestrian Easement

  • Utility easement means an easement of eight feet in width

  • Pedestrian means any person afoot.

  • Easement Area means the area which is hatched on the plan.

  • Conservation easement means a nonpossessory interest of a holder in real property imposing limitations or affirmative obligations the purposes of which include retaining or protecting natural, scenic, or open-space values of real property, assuring its availability for agricultural, forest, recreational, or open-space use, protecting natural resources, maintaining or enhancing air or water quality, or preserving the historical, architectural, archaeological, or cultural aspects of real property.

  • Parking Areas means those portions of the Project which may be used for parking as depicted on the Site Plan, as such areas may be changed by Landlord from time to time.
