New Mexico. If You request cancellation of this Service Agreement within thirty (30) days of the purchase date of the Service Agreement and the refund is not paid or credited within sixty (60) days after return of the Service Agreement to Us, a ten percent (10%) penalty will be added to the refund for every thirty (30) days the refund is not paid. This provision applies only to the original purchaser of the Service Agreement. The Provider of this Service Agreement may cancel this Service Agreement within seventy (70) days from the date of purchase for any reason. After seventy (70) days, the Provider may only cancel this Service Agreement for fraud, material misrepresentation, nonpayment by You or a substantial breach of duties by You relating to the covered property or its use.
New Mexico. The following counties in the State of New Mexico: Bernalillo, Xxxxxxxx, Xxxxx Fe, Torrance, Los Alamos, Rio Arriba, Xxxx, San Xxxxxx as well as any other counties in the State of New Mexico in which the Employee regularly (a) makes contact with customers of the Company or any of its subsidiaries, (b) conducts the business of the Company or any of its subsidiaries or (c) supervises the activities of other employees of the Company or any of its subsidiaries as of the Date of Termination.

NEW YORK Included: All nonprofessional permanent employees and temporary employees with appointments exceeding 90 days employed by the Defense Commissary Agency, located at Fort Xxxxxxxx, Brooklyn, New York and Xxxxxxxx Field, Garden City, New York. Excluded: All professional employees, management officials, supervisors, and employees described in 5 U.S.C. 7112(b) (2), (3), (4), (6) and (7). Included: All nonprofessional permanent full-time employees and part-time employees and temporary employees with appointments of 90 days or more employed by the Defense Commissary Agency located at the United States Xxxxxxxx Xxxxxxx, Xxxx Xxxxx, Xxx Xxxx. Excluded: Professional employees, management officials, supervisors, and employees described in 5 U.S.C. 7112(b) (2), (3), (4), (6) and (7).
New Mexico. CANCELLATION OF THE AGREEMENT section is amended as follows: We may not cancel this Agreement without providing You with written notice at least fifteen (15) days prior to the effective date of cancellation. Such notice shall include the effective date of cancellation and the reason for cancellation. If this Agreement has been in force for a period of seventy (70) days, We may not cancel it before the expiration of the Agreement term or one (1) year, whichever occurs first, unless: 1) You fail to pay any amount due; 2) You are convicted of a crime which results in an increase in the service required under the Agreement; 3) You engage in fraud or material misrepresentation in obtaining this Agreement; or 4) You commit any act, omission, or violation of any terms of this Agreement after the effective date of this Agreement which substantially and materially increases the service required under this Agreement. A ten percent (10%) penalty per month will be applied to refunds not paid or credited within sixty (60) days of receipt of a returned Agreement.

New Mexico. In accordance with the New Mexico state election code, Employees whose work day begins more than two hours after the opening of the polls or ends more than three hours before the closing of the polls are not eligible for paid time off to vote. Supervisors may adjust an Employee’s normal work hours to release the Employee at least three hours before the polls close to allow time to vote. If the supervisor does not adjust an Employee’s work hours, eligible Employees may take up to two paid hours off to vote, which must be scheduled to minimize the amount of disruption to the department’s operation. Voting time may not include lunch periods. If an Employee’s work schedule for the day ends and there are three or more hours for which the polls remain open, the Employee is not entitled to paid time off to vote.
New Mexico. New Mexico currently contains 397,423 acres of modeled DSL Habitat, which is approximately 58 percent of the 684,750 acres of modeled DSL Habitat across the entire range in New Mexico and Texas (according to the Texas State University map). Approximately 76% of the 1,447,137 acre DSL range studied by Xxxxxxx, et al., is within lands managed by the federal or state governments. The New Mexico CCA/CCAA plans, which require strict avoidance of disturbance in all DSL Habitat, cover approximately 1,408,000 acres. DSL Habitat in New Mexico is defined as sand dune complexes with shinnery oak and scattered sand sage (Artemesia filifolia) (FWS, BLM, CEHMM 2008). Areas where honey mesquite or grasses are dominant or co-dominant, and areas of open unvegetated dunes are described as unsuitable for the DSL (Xxxxxxxxxx et al. 1997; Xxxxxxx et al. 2016). Since 2012 when the New Mexico CCA/CCAA began implementation, 577 proposed xxxxx by participants were relocated out of DSL Habitat (CEHMM Annual Report, 2017).
New Mexico. For transactions occurring on or after July 1, 1998, New Mexico will accept this certificate in lieu of a New Mexico nontaxable transaction certificate and as evidence of the deductibility of a sale tangible personal property provided:
