Non-Confidential Information definition

Non-Confidential Information means information which: (i) is, as of the time of its disclosure or thereafter becomes part of the public domain through no fault of the receiving party; (ii) can be demonstrated by credible evidence: (a) as rightfully known to the receiving party prior to the time of its disclosure, or (b) to have been independently developed by the receiving party; (iii) is subsequently learned from a third party not under a confidentiality obligation to the disclosing party; or, (iv) is required to be disclosed pursuant to a duly authorized subpoena, court order, or government authority, provided that the receiving party has provided prompt written notice and assistance to the disclosing party prior to such disclosure, so that such party may seek a protective order or other appropriate remedy to protect against disclosure.
Non-Confidential Information. The Firm and its agents have permission to disclose Client’s identity and financial 155 qualification information to an owner, owner's agents and other third parties without prior consent from Client, unless otherwise 156 provided on lines 151-153. More Definitions of Non-Confidential Information

Non-Confidential Information means: all Information which has entered the public domain other than Information:
Non-Confidential Information means information in the possession of either Authority that is not Confidential Information or has ceased to be Confidential Information;
Non-Confidential Information means information (i) of the disclosing party that was known by the receiving party without any obligation of confidentiality prior to the disclosing party’s disclosure thereof; (ii) of a party that was or becomes publicly available other than pursuant to a breach of this Agreement by the other party; (iii) of a party that was received by the receiving party in good faith on a non-confidential basis from a third party that is not actually known to the receiving party to have disclosed such information in violation of a confidentiality agreement in favor of the other party; (iv) that is independently developed by one party without use of the other party’s Confidential Information; or (v) of a party that is approved for disclosure by that party.
Non-Confidential Information means any information which (a) is or becomes generally available to the public other than as a result of a disclosure by the Lender or the Lender's representatives, or (b) becomes available to the Lender on a non-confidential basis from a source other than the Company or one of its agents or (c) was known to the Lender on a non-confidential basis prior to its disclosure to the Lender by the Company or one of its agents.
Non-Confidential Information where used in this Agreement means information:
Non-Confidential Information means solely such information that, and to the extent it: (i) was known publicly, or was known by the Receiving Party without obligation of confidentiality or non-disclosure, at the time such Property was provided, disclosed, or made available or accessible by the Disclosing Party to, or obtained from the Disclosing Party by, the Receiving Party; or (ii) becomes known publicly thereafter through no action or fault of the Receiving Party or any of its employees, or (iii) is developed, created, discovered, or authored by the Receiving Party independently from this Agreement and any performance hereunder and independently from, and without reference to, any Confidential Information or Technology of the Disclosing Party, or acquired from a third party other than under a confidentiality and non-disclosure obligation; provided, however, that any and all.
