Evicted definition

Evicted or “Eviction” means (a) the lawful deprivation, in whole or in part, of the right of possession or use insured by this policy, contrary to the terms of any Lease or Easement or (b) the lawful prevention of the use of the Land or any Electricity Facility or Severable Improvement for the purposes permitted by the Lease or the Easement, as applicable, in either case as a result of a matter covered by this policy.
Evicted or “Eviction”: (a) the lawful deprivation, in whole or in part, of the right of possession insured by this policy, contrary to the terms of the Lease or (b) the lawful prevention of the use of the Land or the Tenant Leasehold Improvements for the purposes permitted by the Lease, in either case as a result of a matter covered by this policy.
Evicted means physically removed from a dwelling unit by order of a court. However, if CHA relocates a tenant who receives or has received a notice to quit alleging serious or repeated violations of material terms of his/her CHA lease, the CHA is not waiving its rights to proceed with the eviction based on that notice to quit. Relocation benefits and assistance (including temporary and permanent housing; moving, storage and related expenses; replacement housing expenses; the right to return to his/her original unit at Newtowne Court after that phase is completed provided the resident remains on-site during construction or moves in with family or friends while construction is occurring in his/her unit; and the right to return to Newtowne Court (but not necessarily to the original unit) after the construction is completed) will be provided in accordance with this Agreement and the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, and the requirements specified in PIH Notice 2012-32, Rev 1, RAD Final Implementation Notice and PIH Notice 2014 -17 Relocation Requirements under the Rental Assistance Demonstration (RAD) Program, Public Housing in the First Component. See Attachment B for a relocation budget for Newtowne Court. All references to Newtowne Court tenants/residents and households in this Agreement mean those Newtowne Court tenants eligible as identified above.

  • Eviction means any action by a landlord, owner of a residential property, or other person with a legal right to pursue eviction or a possessory action, to remove or cause the removal of a covered person from a residential property. State and local laws with respect to tenant-landlord relations vary, as do the eviction processes used to implement those laws. The judicial process will be carried out according to state and local laws and rules. Eviction does not include foreclosure on a home mortgage.

  • Major Tenant means a tenant of a Loan Party under a lease of Property which entitles it to occupy 15,000 square feet or more of the net rentable area of such Property.

  • Occupant means any person or persons over the age of eighteen years in possession of the property.

  • noise nuisance means an unwanted sound, in an affected area, which is annoying, troublesome, or disagreeable to a person:

  • relevant premises means any office premises occupied by the Appointee in relation to the Appointed Business and to which members of the public have access;

  • Superior Lease means the document which sets out the obligations your Landlord has made to their Superior Landlord. The promises contained in this Superior Lease will bind the Tenant if they have prior knowledge of those promises.

Forcible felonies are not willful injury in violation of Iowa Code section 708.4, subsection 2; sexual abuse in the third degree committed between spouses; sexual abuse in violation of Iowa Code section 709.4, subsection 2, paragraph “c,” subparagraph (4); or sexual exploitation by a counselor or therapist in violation of Iowa Code section 709.15.

  • Substantial Taking means a Taking of at least 15% of the Land or Improvements which, in Lessee’s and Lessor’s reasonable judgment, will materially and adversely interfere with any development or use of the Premises that Lessee is then conducting or intends in good faith to conduct in the future.

  • Condemnor means any public or quasi-public authority, or private corporation or individual, having the power of Condemnation.

  • Master Lease means any master lease now or hereafter entered into, in which the Healthcare Facility is aggregated with other HUD-insured healthcare facilities and leased to a Master Tenant and any amendments or joinders thereto.
