  • With respect to the calculation of a Realized Loss on a Mortgage Loan subject to a Deficient Valuation, the amount of the Realized Loss is the difference between the Unpaid Principal Balance of the related Mortgage Loan immediately prior to the Deficient Valuation and the Unpaid Principal Balance as reduced by the Deficient Valuation.

Deficient means any one or a combination of the following items or other items of a substantially similar nature:
Deficient or “Defective” means with respect to a Product, that such Product did not, at the time of Delivery, meet the quality requirements set out in this Agreement, the Quality Agreement, the Specifications, the cGMPs or Applicable Laws, and “Defect” shall be construed accordingly.
