Defective Product definition

Defective Product has the meaning set forth in Section 5.2.
Defective Product means a Product with a Defect.
Defective Product means any Product that does not comply with the Specifications, the Purchase Order, Statement of Work or other provisions of this Agreement.

Examples of Defective Product in a sentence

  • If Seller determines that a Defective Product pursuant to this section 5 cannot be replaced within [***] Business Days, Seller may direct Buyer to return the Defective Product to Seller or destroy it, in each case at Seller’s sole cost and expense, and Seller will promptly reimburse Buyer for the price actually paid by Buyer to Seller for such Defective Product; provided that the Defective Product shall be credited against the Annual Base Quantities.

  • If Seller directs Buyer to destroy the Defective Product, Buyer shall send the certificate of destruction by an external laboratory as evidence of the destruction of the entire quantity of Defective Product.

  • If a recall campaign is implemented with respect to a Defective Product, at Buyer’s option, Seller shall promptly replace any Defective Product and provide such replacement Product to Buyer or Buyer’s designee.
