Latent Defect definition

Latent Defect means a defect, inherently lying within the material or arising out of design deficiency, which do not manifest themselves and/or was not reasonably discoverable during Defect Liability period.
Latent Defect means any omission from, fault within, deficiency in or any other aspect of the Supplies and Services which, during the Life of the Supplies and Services, preclude the Supplies and Services from meeting the requirements of the Specifications;

Examples of Latent Defect in a sentence

  • Client shall give Halo written notice of any claim that a Batch is Non-Conforming Product and a sample of the allegedly Non-Conforming Product (together, a “Deficiency Notice”) within [***] days after Client’s receipt of such Batch or, in the case of a Latent Defect, within [***] days after Client’s discovery of the Latent Defect, but in no event after the expiration date of the Batch in question.

  • Catalent will work in good faith with Client to identify the cause of nonconformity in the case that Client provides notice of Defective Product after the Review Period (or after the period in the definition of Latent Defect with respect to any Latent Defect).

  • Upon receipt of notice from Client that a Batch conforms to the Specifications, or upon failure of Client to provide any written notice to Catalent by the end of the Review Period subject to Section Error! More Definitions of Latent Defect

Latent Defect means any work or repair, amendment, reconstruction, rectification, defect, imperfection or other fault which only becomes apparent to WAPCOS Limited following the expiry of the Defects Rectification Period and which is due to the use of materials or workmanship not in accordance with the Contract or the neglect or failure of the Contractor to comply with any of its obligations, express or implied, under the Contract.
Latent Defect means a fault or defect that would not readily be revealed by a reasonable inspection.
Latent Defect means a Defect which a reasonable inspection of the Goods by the Purchaser’s Representative would not detect.
