Latent Defect definition

Latent Defect means a defect, inherently lying within the material or arising out of design deficiency, which do not manifest themselves and/or was not reasonably discoverable during Defect Liability period.
Latent Defect means a defect that causes a Product to fail to conform to the Specifications or to the warranties provided by Manufacturer hereunder, which defect is not discoverable upon reasonable physical inspection and testing performed pursuant to Section 5.1 and the Quality Agreement but is discovered at a later time (e.g., in the course or as a result of long-term stability studies).

  • For purposes of this Section 5.7 “Latent Defect” means a defect that exists at the time of delivery as described in Section 6.1, causes the Product to be Defective Product, and was not discoverable upon reasonable physical inspection of the Product or accompanying paperwork at the time of receipt by Client but is discovered at a later time; provided that a Product will not be deemed to contain a Latent Defect if the defect is attributable to defective Client-supplied Materials.

Latent Defect means any work or repair, amendment, reconstruction, rectification, defect, imperfection or other fault which only becomes apparent to WAPCOS Limited following the expiry of the Defects Rectification Period and which is due to the use of materials or workmanship not in accordance with the Contract or the neglect or failure of the Contractor to comply with any of its obligations, express or implied, under the Contract.
