Upon receipt of such a report from the concerned Planning Authority/ Maha-Metro and after conducting its own inspection, if the concerned Planning Authority/ Maha-Metro is of the opinion that the Project is not fit and safe for commercial service, it shall, within 15 (fifteen) days of receiving the aforesaid report, notify the Concessionaire of the defects and deficiencies in the Project and withhold the issuance of the Construction Completion Certificate.
Reporting shall continue until the Concessionaire has completed all the Works, services, facilities and the Construction Completion Certificate is issued.
The tenure of the Independent Engineer, under this Concession Agreement, shall be from the Compliance Date to the date of issue of the Construction Completion Certificate.
For clarity, a Construction Completion Certificate will not be issued by the Municipality if the Developer fails to deliver all required testing records, record drawings, and Tangible Capital Assets information to the Municipality’s satisfaction.
Further, the Developer will provide to the Municipality a list of all such lots that have fill areas in excess of the said one (1) meter prior to the issuance of a Construction Completion Certificate.
