Commercial Completion Date definition

Commercial Completion Date means the earlier of (a) the date that is two (2) years following the Execution Date and (b), with respect to all facilities described on Schedule 1.1(b) other than those facilities which Buyer, the Company or the Entities are no longer diligently pursuing, (i) the date on which the Independent Engineer certifies that such facilities have completed all required performance tests and are built to the specifications outlined in the relevant documents as described in Schedule 1.1(b) inclusive of all engineering procurement and construction contracts or (ii) the date that such facilities are constructed capable of operating in accordance with their intended purpose at stated capacity, as applicable.

  • Mechanical Completion means that (a) all components and systems of the Project have been properly constructed, installed and functionally tested according to EPC Contract requirements in a safe and prudent manner that does not void any equipment or system warranties or violate any permits, approvals or Laws; (b) the Project is ready for testing and commissioning, as applicable; (c) Seller has provided written acceptance to the EPC Contractor of mechanical completion as that term is specifically defined in the EPC Contract.

  • Successful Completion means that in the reasonable opinion of the Customer, Deliverables completed by the Supplier are fit for purpose, completed on time and otherwise meet all the criteria defined under this Contract;

  • Completion Period means the period starting from the date of issue of "Order" and required to complete the work in all respect.

  • Scheduled Project Completion Date shall have the meaning specified in Section 6.3 (c);

  • Virtual Completion means the premise is in the opinion of the Employer fit for occupation.

  • Commercial Operation Date (COD) means the date certified by the DISCOM’s committee upon successful commissioning (as per provisions of the PPA) of the project when all equipments as per rated capacity have been installed and energy has flown into the grid.

  • Construction Completion means physical construction of a cleanup action component is complete.

  • Time of Completion means the time for completing the execution of and passing the Tests on Completion of the Works of any section or part thereof as stated in the Contract (or as extended under Clause...) calculated from the Commencement Date

  • Guaranteed Substantial Completion Date or “Guaranteed Substantial Completion Dates” has the meaning set forth in Section 5.3B.
