Temporary Storage and Pumping. Matodol and City are hopeful that the Trunk Sewer Lines and applicable Internal Sewer Line(s) will all be completed prior to the Completion Date to enable building(s) to receive a certificate of occupancy and to be serviced through said sewer lines. In the event the applicable Internal Sewer Line(s) or the Riparian Xxx Xxxx Creek Sewer Line and applicable Internal Sewer Line(s) are completed by the Completion Date, but the other Trunk Sewer Line(s) are not completed prior to the Completion Date, then the City will allow the following:

Temporary Storage and Pumping. Property Owner and City acknowledge the Salt Creek Trunk Extension will not be substantially completed until December, 2020 (after the Trunk Completion Date), which has delayed the commencement of construction on the SW Subbasin Extension. The SW Subbasin Extension will be designed by the City and ready to bid in late summer 2020, with substantial completion by March 31, 2021 (“Subbasin Completion Date”). If the Internal Sewer Line(s) are completed by Property Owner prior to the completion of the SW Subbasin Extension, but the SW Subbasin Extension has been designed and bid by the City, the City will allow the following:
Temporary Storage and Pumping. Southwood and the City are hopeful that the South Salt Creek Trunk Sewer, Sub Basin Sewer Line Phase I and II and Southwood Sewer Connection will be completed prior to Southwood requesting a certificate of occupancy for the new church to enable the Southwood Tract to be sewered through the City’s wastewater system. In the event the South Salt Creek Trunk Sewer, Sub Basin Sewer Line Phase I and II and Southwood Sewer Connection would not be completed prior to Southwood requesting a certificate of occupancy for the new church, then the City and the Church will use their best efforts to enter into a discussion and possible written agreement allowing Southwood to temporarily collect, store and pump wastewater received from the church in a wastewater collection system until such time as the South Salt Creek Trunk Sewer, Sub Basin Sewer Line Phase I and II and Southwood Sewer Connection is constructed. The City hereby authorizes the Mayor, with input and advice by the City Attorney, to enter into such a written agreement with Southwood, with terms and conditions that will adequately protect the public’s health and safety.
