Summer Layoff Procedure. The Employer shall select the position(s) to be eliminated. All the employees from the most seniored affected employee whose position is eliminated, where there has been a reduction in posted hours and/or benefits, or a shift change to the least seniored employee whose position is eliminated, where there has been a reduction in posted hours and/or benefits, or a shift change shall meet with the administration prior to the layoff date. On a seniority basis, employees may select any position held by a less seniored employee; however, employees must meet the necessary qualifications to select positions. When all positions are filled, the remaining persons shall be laid off. This procedure shall also be used during the summer following a school year layoff. Meeting dates shall be set prior to the end of each school year. The Association president shall be notified by June 1.

On a seniority basis, employees may select any position held by a less seniored employee; however, employees must be qualified to select positions that require bilingual and/or V.I. abilities as their primary emphasis. Unless otherwise agreed by the disputing Parties within 20 days following the establishment of the Panel, the terms of reference shall be: "To examine, in light of the relevant provisions of this Agreement, the matter referred to in the request for the establishment of a Panel pursuant to Article 177 (Request for a Panel) and to make findings of law and fact together with the reasons therefore for the resolution of the dispute, as well as a recommendation for its implementation, if needed."
