Residential Zoning Parcels. Concurrent with the recording of any final plat for any residential Development Phase, Applicant agrees to record a declaration of covenants (“Residential Declaration”) against such residential Development Phase, and ultimately on the entire residential Zoning Parcel, which covenants shall have previously been submitted and approved by the City (which approval shall not be unreasonably withheld), and which shall provide for the creation of and mandatory membership in an Owners Association by all residential dwelling unit owners, and which shall further provide for, among other things: (i) the care and maintenance of the Stormwater Management Facilities serving the residential Development Phase, excluding all storm sewer pipes, inlets and structures which are conveyed to, owned and maintained by the City; (ii) lawn and landscape maintenance of other common areas, including fences, walls and signage, located within the residential Development Phase;

The Residential Declaration shall provide for the right (but not the obligation) of the City to enforce the Residential Declaration, as well as the right (but not the obligation) to perform or cause the same to be performed upon the failure of the Owners Association to perform the same within thirty (30) days following the Owners Association‟s receipt of written notice from the City identifying the specific violations or non-performance of the Maintenance Covenants and demanding such work to be performed by the Owners Association. The Residential Declaration shall provide for not more than one Owners Association per Zoning Parcel, except that a Master Association shall be permitted with respect to any one more Zoning Parcels in addition to the specific Zoning Parcel Owners Association. With the concurrence of the Contractor, the extension may be for a period of up to 6 months in lieu of 3 months.
