Procurement of Similar Services. The District may procure, upon such terms and in such manner as it deems appropriate, services similar to or in replacement of those CM Services terminated in accordance with this Agreement. The District shall in such event have the right to use as it may determine, and to provide to the person or entity providing such similar or replacement services, any and all documents, schedules, estimates, or other materials prepared or obtained by the Construction Manager pursuant to this Agreement.

  • Procurement of Small Works Works estimated to cost less than $50,000 equivalent per contract, up to an aggregate amount not to exceed $500,000 equivalent, may be procured under lump-sum, fixed-price contracts awarded on the basis of quotations obtained from three (3) qualified domestic contractors in response to a written invitation. BNY Mellon will remediate identified security vulnerabilities in accordance with its process.
