Other Covenants of Lessee. Failure by the Lessee to observe and perform any covenant, condition or agreement on its part to be observed or performed, other than as referred to in Section 5.1(a), for a period of thirty (30) days after written notice thereof by the Trustee to the Lessee, specifying such failure and requesting that it be remedied, unless the Trustee shall agree in writing to an extension of such time prior to its expiration; provided, however, that if the failure stated in the notice cannot be corrected within the applicable period, the Trustee will not unreasonably withhold its consent to an extension of such time if corrective action is instituted by the Lessee within the applicable period and diligently pursued until the default is corrected.

Other Covenants of Lessee. Section 15.1. If any excavation or other building operation shall be made upon the Premises or any adjoining property by Lessee, Lessee agrees to assume all obligations of both the owner and the occupant of the Premises with respect to shoring and lateral support and to do all things necessary or desirable to preserve and protect the Premises.

Construction/performance of Capital Projects will be prosecuted by Lessee in accordance with the Plans in a good and workmanlike manner and in accordance with sound building and engineering practices and all applicable Legal Requirements. All materials, fixtures or articles used in the construction/performance of the Capital Projects, or to be used in the operation thereof shall be substantially in accordance with the Plans as prepared by the Architect and approved by Lessor. Lessee shall ensure that no asbestos or asbestos-containing materials or other Hazardous Substances will be contained in the completed Capital Projects. Lessee will complete the construction/performance of the Capital Projects substantially in accordance with the Plans on or before the Outside Date, free and clear of liens or claims for liens for material supplied and for labor or services performed in connection with the construction of the Capital Projects (except for permitted contests pursuant to Article XII of the Lease).
