Objectives Of The Protocol And The Work of The Committee. The objective of the Committee is to facilitate and encourage the reintegration of employees with disabilities into the workforce, in a co-operative, constructive and effective manner, consistent with the needs of the affected employee and the other employees in the bargaining unit and the successful operation of the business. Expert Advice In order to achieve the objective described above, the Committee may obtain such expert advice and reports from medical practitioners, ergonomists, etc., as the Committee may determine is necessary to complete its’ evaluation of the employee’s medical condition and/or the workplace. Administrative expenses of the Committee, as determined by the Committee, shall be borne by the Company, including the expenses incurred in obtaining such medical, ergonomic or other reports which the Committee may require from time to time as the case may be. It is recognized that the general law and in particular the Ontario Human Rights Code, requires that disabled employees be accommodated in the workplace to the point of undue hardship. This accommodation may involve the modification of the employee’s job or the workplace. It is also recognized that the Duty to Accommodate involves a tri-partite inquiry, including the Company, the Union, and the affected employee. This protocol is intended to assist the parties with their respective obligations in that process
