– MANAGEMENT RIGHTS 5. 01 Except where specifically abridged by the terms of this Agreement, the management of the Company’s operations and the selection and direction of employees will continue to be vested exclusively with the Company.
– MANAGEMENT RIGHTS 5. 01 The University has and retains all of its rights and privileges, which it has not expressly modified or restricted by a specific provision of this collective agreement, to allow it to effectively manage and administer its activities. The University recognizes its responsibility to exercise its management rights in conformity to the provisions of the present collective agreement.
– MANAGEMENT RIGHTS 5. 01 Amend as follows: The management of the plants and the direction of the working forces, including the right to hire, suspend, promote, transfer or discharge for just cause, and the right to relieve employees from duty because of lack of work or other legitimate reasons is vested exclusively in the Company; provided, however, that the Company shall exercise these rights in a manner consistent with the other provisions of this Agreement.
– MANAGEMENT RIGHTS 5. 01 The Union acknowledges that the Management and direction of employees in the bargaining unit is retained by the Employer, except as this Agreement otherwise specifies.
– MANAGEMENT RIGHTS 5. 01 The Union agrees that the management and control of the Employer's business and the direction and control of the Employer's work force are vested exclusively in the Employer, by the provisions of this Agreement; provided however, that this authority will not be used for purposes of discrimination against its employees. The Employer shall have the right to select, to train, to promote, to discipline, to suspend without pay, and to discharge employees for proper cause. It is understood that an employee shall not lose the employee’s right to grievance through the grievance procedure.
– MANAGEMENT RIGHTS 5. 01 Subject to the terms of this Agreement, the Union acknowledges that the supervision, management and control of the company's business and plants are exclusively the function of the Management.
– MANAGEMENT RIGHTS 5. 01 The Association recognizes that the Employer has retained and shall possess and exercise all rights and functions, powers, privileges and authority that the Employer possessed prior to the signing of this Agreement with the Association, excepting those that are clearly and specifically relinquished or restricted in this Agreement, or modified by statute. The Employer undertakes that all rights and functions, powers, privileges and authority shall be exercised in a manner consistent with the provisions of this Agreement. 5.02 The Employer’s failure to exercise any right, function, power, privilege or authority hereby reserved to it, or the Employer’s exercise of any such right, function, power, privilege or authority in a particular way, shall not be considered a waiver of the Employer’s right to exercise such right, function, power, privilege or authority, or preclude it from exercising the same in some other way not in conflict with the express provisions of this Agreement.
