Laws and Licenses. This Agreement is subject to all applicable federal, state and local laws, regulations, rulings and orders of governmental agencies, including, but not limited to, the Communications Act of 1934 as amended by the Telecommunications Act of 1996, and the rules and regulations of the FCC. IXC and PSINet agree that, except as otherwise provided herein, the statute of limitations set forth in the Communications Act of 1934, 47 U.S.C. section 415, as amended, shall govern all actions arising out of this Agreement, including arbitrations.
Laws and Licenses. Company has complied and will comply with all applicable laws, rules and regulations and shall, whenever necessary, obtain and maintain at its own expense all licenses required for it to perform this Agreement.

Laws and Licenses. 20 Franchisee shall comply with all federal, State, and County laws, ordinances, rules, and regulations 21 applicable to the performance of the services hereunder and shall obtain all licenses and permits necessary 22 to perform the services hereunder and maintain the same in full force and effect. 24 K. Waiver. 25 26 No waiver by either party of any one or more defaults or breaches by the other in the performance of 27 this Agreement shall operate or be construed as a waiver of any future defaults or breaches, whether of a 28 like or different character.

References herein to any Law or any license mean such Law or license, as amended, modified, codified, reenacted, supplemented or superseded in whole or in part, and in effect from time to time prior to the Closing Date, and references herein to any Law shall be deemed also to refer to all rules and regulations promulgated thereunder.

Franchisee shall comply with all federal, state, and City, County or local laws, ordinances, rules, and regulations applicable, from time to time and as amended, to the performance of the Solid Waste Handling services provided under this Franchise Agreement and shall obtain and maintain in full force and effect all licenses and permits necessary to perform such services throughout the term of this Franchise Agreement.

City and Franchisee shall, at their own separate costs, comply with all federal, State, and City laws, ordinances, rules, and regulations applicable to the performance of the services hereunder and Franchisee shall obtain and maintain in full force and effect throughout the term of this Agreement all licenses and permits necessary to perform the services hereunder.
