Facsimile Delivery. This Agreement may be duly executed and delivered by a Party by execution and facsimile or electronic, “pdf” delivery of the signature page of a counterpart to the other Party.
Facsimile Delivery. This Agreement may be delivered by facsimile transmission of an executed counterpart signature page hereof, and after attachment of such transmitted signature page to a copy of this Agreement, such copy shall have the same effect and evidentiary value as copies delivered with original signatures. Any party delivering this Agreement by facsimile transmission shall deliver to the other party, as soon as practicable after such delivery, an original executed counterpart signature page of this Agreement.
Facsimile Delivery. This Agreement may be duly executed and delivered by a Party by execution and facsimile delivery of the signature page of a counterpart to the other Party, and, if delivery is made by facsimile, the executing Party shall promptly deliver, via overnight delivery, a complete original counterpart that it has executed to the other Party, but this Agreement shall be binding on and enforceable against the executing Party whether or not it delivers such original counterpart.
Facsimile Delivery. The parties may sign and deliver this Agreement by facsimile transmission. Each party agrees that the delivery of the Agreement by facsimile shall have the same force and effect as delivery of original signatures and that each party may use such facsimile signatures as evidence of the execution and delivery of the Agreement by all parties to the same extent that an original signature could be used.
Facsimile Delivery. 36 IRU AND STOCK PURCHASE AGREEMENT IRU AND STOCK PURCHASE AGREEMENT made as of this 22nd day of July, 1997 by and between PSINet Inc., a New York corporation ("PSINet"), and IXC Internet Services, Inc., a Delaware corporation ("IXC").
Facsimile Delivery. This Agreement, once executed by any party hereto, may be delivered to the other party by facsimile transmission.
Facsimile Delivery. This Agreement, each of the Related Agreements, and any amendments hereto or thereto, to the extent signed and delivered by means of a facsimile machine, shall be treated in all manner and respects as an original agreement or instrument and shall be considered to have the same binding legal effect as if it were the original signed version thereof delivered in person. At the request of any party hereto or to any such agreement or instrument, each other party hereto or thereto shall reexecute original forms thereof and deliver them to all other parties. No party hereto or to any such agreement or instrument shall raise the use of a facsimile machine to deliver a signature or the fact that any signature or agreement or instrument was transmitted or communicated through the use of a facsimile machine as a defense to the formation or enforceability of a contract and each such party forever waives any such defense.
Facsimile Delivery. Counterparts of this Amendment may be executed by facsimile signature, which shall be effective upon delivery of a copy of this Amendment bearing said facsimile signature.
Facsimile Delivery. This Agreement may be delivered upon the provision of telefaxed execution pages provided that the party delivering such telefaxed execution pages shall as soon as practicable thereafter deliver to the other parties an originally executed execution page.
Facsimile Delivery. Any signature page delivered by facsimile or electronic image transmission (including in the form of a PDF file or any electronic signature complying with the U.S. federal ESIGN Act of 2000, e.g., xxx.xxxxxxxx.xxx) shall be binding to the same extent as an original signature page. Any party that delivers a signature page by facsimile or electronic image transmission shall deliver an original counterpart to any other party that requests such original counterpart.
