The methodologies used by DESC to calculate its avoided energy and capacity costs under PURPA for its proposed Rate PR-1 and Rate PR-Standard Offer are reasonable and prudent; satisfy the requirements of PURPA, FERC’s implementing regulations and guidelines, and Act No. 62; and are approved for use on, during, and after the first billing cycle of the month following the date of this order.

The settlement proposed in the Settlement Agreement has been negotiated in good faith at arm’s length and is preliminarily determined to be fair, reasonable, adequate, and in the best interests of the Settlement Class in light of the factual, legal, practical and procedural considerations raised by this case.
