Hazardous Materials Report. Contents. The Report shall contain, without limitation, the following information:
Hazardous Materials Report. A Phase I environmental site assessment by a properly qualified engineer with respect to the Property;
Hazardous Materials Report. A detailed report by a properly -------------------------- qualified engineer with regard to Hazardous Materials affecting the Property, which shall include, inter alia, a certification that such engineer has examined a list of prior owners, tenants and other users of the Property, and has made an on-site physical examination of the Property and Improvements, and a visual observation of the surrounding areas, and disclosing the extent of past or present Hazardous Materials activities or of the presence of Hazardous Materials;
Hazardous Materials Report. City acknowledges receipt of the “Final Removal Action Workplan” dated May 9, 2009, prepared by TRC on behalf of Vista Montana Park Homes LLC and ERP Operating Limited Partnership, approved by DTSC on May 9, 2008 and “Notice of Determination” by DTSC dated May 9, 2009 approving the Final Remedial Action Workplan, and hereby concurs that these documents satisfy City’s requirements for the Hazardous Materials Report under this Agreement.
Hazardous Materials Report a. Provide surveys of Hazardous Materials and provide assessments of abatement of all asbestos containing materials (ACM) and related treatment required to support intended uses. Develop acceptable Engineering solutions to be included within the Construction Documents.
Hazardous Materials Report. At any time during the Term, upon five (5) days prior written notice to Lessee, Lessor may arrange for the preparation, including the tests necessary therefor, of a written report by a professional consultant with respect to Hazardous Materials (the "Report"). Should the Report indicate the existence of Hazardous Materials in excess of the levels specified in that report described in Exhibit "J" attached hereto (the "Hazardous Materials Report") which indicates the level of Hazardous Materials, if any, in existence on the Leased Premises at date hereof and further, the presence of such Hazardous materials has been caused by the Hazardous Use by Lessee, then, in such case, the cost of the Report shall be borne by the Lessee and Lessee shall pay the full cost thereof within ten (10) days following the date it receives a written invoice therefor. If the Report does not so indicate, Lessor shall bear the cost of the Report.
Hazardous Materials Report. When Required. Tenant shall submit to Landlord a written report with respect to Hazardous Materials ("Report") in the form prescribed in Subsection (g) below on the following dates:
Hazardous Materials Report. Lessee agrees that if Lessee is unable for any reason to complete the certification provided for in Paragraph 1.3. below, Lessee shall obtain and deliver to Lessor within five days before or after the termination of this Lease a hazardous substance report concerning the Premises ("Hazardous Materials Report"), the purpose of which Hazardous Materials Report shall be to affirm that Lessee shall be in compliance with all applicable laws, ordinances, rules, regulations of any governmental agency having jurisdiction concerning the use, storage and/or dispositions of hazardous materials on the Premises at the termination of this Lease or any extension thereof. The Hazardous Material Report shall be obtained by Lessee at its sole cost and expense, for the purposes of this report, a "hazardous material" is defined as any substance the existence or effect of which is subject to Federal, State or Local regulation, investigation, correction or removal as potentially injurious to public health or welfare. Lessor and Lessxx xxxnowledge that extensive Local, State and Federal legislation establishes broad liability upon owners and/or users of real property for the investigation and correction of such hazardous material conditions. The Hazardous Material Report shall be in writing, and shall be prepared by a licensed contractor or engineer competent to perform such investigation on behalf of Lessxx. Xx the Hazardous Materials Report shall indicate a condition requiring correction or posing a potential liability to Lessor, Lessee shall forthwith cure the condition(s) specified in the Hazardous Materials Report at Lessxx'x xole cost and expense, prior to the termination of this Lease.
Hazardous Materials Report. By its execution of this Agreement, Optionee acknowledges its receipt of the Owner Hazardous Materials Report. Optionee acknowledges and agrees that the Owner Hazardous Materials Report is provided by Owner for informational purposes only, that Owner does not make any representations or warranties as to the accuracy or completeness of the Owner Hazardous Materials Report.
