Asbestos Containing Materials. The use of materials or equipment containing asbestos is prohibited under this contract. Contractor warrants that all materials and equipment incorporated in the project are asbestos-free.

Asbestos Containing Materials. To the extent any of Tenant’s repairs, maintenance or Alterations (as defined below), including any Required Improvement or Deferred Maintenance Item, require the abatement, removal, disposal or encapsulation of asbestos containing materials (“ACM”) at the Facility, Landlord shall bear all costs and expenses relating to such ACM (and Tenant shall have no obligation to pay the Annual Yield on such amount).
Asbestos Containing Materials. Tenant acknowledges and agrees that (i) the Project was constructed at a time when asbestos was commonly used in construction, (ii) asbestos and asbestos-containing materials (collectively, “ACM”) may be present at the Project, and (iii) airborne asbestos fibers may be released and result in a potential health hazard if proper ACM containment, remediation and abatement procedures are not observed. Except as otherwise provided in this Lease and the Tenant Work Letter, Tenant shall be responsible for all costs related to ACM that arise in connection with Tenant’s modification, alteration or improvement of the Premises. Landlord shall be responsible for all costs related to ACM that arise in connection with Landlord’s work and delivery of the Premises to Tenant (the “Landlord ACM Work”). All of the Landlord ACM Work shall comply with appropriate procedures as recommended by Landlord’s asbestos consultant, and shall include, without limitation, air-sampling as recommended by Landlord’s asbestos consultant which shall occur following the completion of all of Landlord’s other demolition work in the Premises. All the Landlord ACM Work shall comply with all applicable laws, rules, regulations and other governmental requirements relating to ACM. In connection with any modifications, alterations or improvements contemplated to be performed by Tenant in the Premises, Tenant (including its contractors and other agents) shall consult with Landlord and Landlord’s asbestos consultant concerning appropriate procedures to be followed in connection with ACM prior to performing any such work in the Premises. All such work shall be subject to the terms of Article 8 below. During the performance of any such work, Tenant (including its contractors and other agents) shall comply with all applicable laws, rules, regulations and other governmental requirements, as well as all directives of Landlord and Landlord’s asbestos consultant, relating to ACM. Tenant hereby irrevocably appoints Landlord and Landlord’s asbestos consultant as Tenant’s attorney-in-fact for purposes of supervising and directing any ACM-related aspects of Tenant’s contemplated work in the Premises (provided that such appointment shall not relieve Tenant from its obligations hereunder, nor impose any affirmative obligation on Landlord to provide such supervision or direction). Asbestos Containing Materials. If applicable, the Contractor shall complete an asbestos inspection in accordance with the EPA National Emission Standards for Hazardous Air Pollutants (“NESHAP”) Regulations under 40 CFR Part 61 prior to the completion of the design documents. If present, the Contractor shall remove asbestos containing materials prior to being impacted by the proposed expansion project.
Asbestos Containing Materials. Many of the existing buildings within the NRP are known to contain asbestos-containing materials (“ACM”) as a result of a limited asbestos survey of housing units conducted by the Navy in 1988, a basewide asbestos survey conducted by Tetra Tech in 1993, and sampling of several individual buildings that was conducted as a result of building modifications being performed. In addition to the buildings with confirmed or suspect ACM present, other buildings are assumed to likely contain ACM due to their age (Xxxxxxx, 2000a). NASA has conducted surveys of buildings in the NRP to identify and evaluate the presence or absence of asbestos (Benchmark, 2001, 2003). The EBS Reports prepared by Xxxxxxx (Xxxxxxx, 2000a, 2001a, 2001c, 2001b) summarize the results of asbestos, surveys that have been completed for buildings in the NRP. Additional information regarding the potential presence of asbestos in buildings has been obtained by NASA in the course of ongoing building renovations within the NRP. Hard copy reports of the asbestos surveys conducted to date at the NRP are located in the NASA ARC Occupational Safety Health & Medical Services Office (Xxxxx, 2003).

Tenant and its general contractor shall verify that no material used in the work performed under its contract contains asbestos fibers. An MSDS sheet must be submitted for all products used.
Asbestos Containing Materials. Without limiting Section 23.1 (No Hazardous Materials), in the event that asbestos-containing materials ("ACM") are determined to exist in or about the Premises, Tenant shall ensure that all Alterations and any asbestos related work, as defined in California Health & Safety Code Section 25914.1(b), is performed in compliance with all laws relating to asbestos, including but not limited to California Occupational Safety and Health (OSHA) regulations found in Title 8 of the California Code of Regulations, Sections 1502 and 1529. Additionally, Tenant shall distribute notifications to all employees and contractors as required pursuant to California Health & Safety Code Section 25915 et seq. informing them of the existence of ACM and that moving, drilling, boring, or otherwise disturbing ACM may present a health risk and should not be attempted by an unqualified employee. No Alterations affecting ACM-containing areas or any asbestos related work shall be performed without Landlord’s prior written consent in each instance.
