That The High Court In Malaya And The High Court In Sabah And Sarawak Each Has Its Own Separate Territorial Jurisdiction, There Exists In Law Two Separate Supervisory Jurisdictions In Malaysia Over Arbitrations Or Arbitration Awards, Namely One Under The High Court In Malaya And One Under The High Court In Sabah And Sarawak. [175] As would have been understood from reading this judgment we have determined that the exclusive supervisory jurisdiction of a domestic arbitration is to be ascertained from the juridical seat of the arbitration. The court at the seat enjoys exclusive supervisory jurisdiction over the arbitral proceedings and the award. [176] As such it is not correct to state that there subsists in law “two separate supervisory jurisdictions”.
