FRB. The term “FRB” means the Board of Governors of the Federal Reserve System or any successor thereto.

Hedge Agreements: Interest rate swap, interest rate cap or interest rate collar agreements. Indebtedness: As to any corporation, any obligation of, or guaranteed or assumed by, such corporation for (i) borrowed money evidenced by bonds, debentures, notes or other similar instruments, (ii) the deferred purchase price of property or services (excluding trade and other accounts payable), (iii) the leasing of tangible personal property under leases which, under any applicable Financial Accounting Standards Board Statement, have been or should be recorded as capitalized leases or (iv) direct or contingent obligations under letters of credit issued for the account of such corporation.
