Evaluation Notice. As specified in the FAR 52.215-1 “Instructions to Offerors--Competitive Acquisition” provision, the Government intends to evaluate proposals and award without discussions. An offer must be acceptable for the Offeror to be eligible for award. OFFERS THAT DO NOT CONFORM TO THE REQUIREMENTS STATED HEREIN MAY BE DETERMINED UNACCEPTABLE AND MAY BE REJECTED WITHOUT FURTHER EVALUATION.

Evaluation Notice. The appropriate Educational Administrator will forward a written notice to the faculty member by the third week of the semester of an upcoming evaluation and pre-evaluation conference. The notice shall be given to the faculty member at least two (2) weeks prior to the pre-evaluation conference. The faculty member will be required to provide a self-evaluation including professional responsibilities, and for instructional faculty, syllabus, and class materials for the class(es) to be evaluated at the pre-evaluation conference.
Evaluation Notice. Within ten (10) days following receipt of the Initial Offer, Purchaser shall notify Sellers in writing whether or not Purchaser intends to evaluate the Offered Properties (an “Evaluation Notice”). If the Evaluation Notice indicates that Purchaser does not wish to evaluate the Offered Properties or if Purchaser fails to deliver an Evaluation Notice to Sellers within such ten (10) day period, Sellers (or the Affiliate) shall be free to negotiate and conclude a sale, as specified in the Offer, of the Offered Properties with other Persons for a period of one (1) year following receipt by the Purchaser of the Offer. If the Evaluation Notice is received by Sellers within such ten (10) day period and it indicates that Purchaser wishes to evaluate the Offered Properties, then for thirty (30) days following receipt by Sellers of the Evaluation Notice, Purchaser shall have the right to evaluate the Offered Properties (the “Evaluation Period”) and the remainder of this Section 7.7 shall apply.

If the Commission or any state securities commission shall enter a stop order or suspend such qualification at any time, the Company will make every reasonable effort to obtain promptly the lifting of such order.
