Employment Relations Xxx 0000. Nothing in this Agreement shall detract from or otherwise affect the operation of the provisions of the Employment Relations Act relating to personal grievances or to the enforcement of the Employment Contract generally.
Employment Relations Xxx 0000. Notwithstanding the provisions of clause 16 (currently clause 3), where the employer is proposing to sell, transfer, merger or contract out the whole or part of the employers business, the employer shall negotiate with the person who undertakes or proposes to undertake the employers business (or part of it) or to whom the employer’s business (or part of it) is, or is to be, sold, transferred, merged or contracted out (the ‘new employer’) about the transfer of affected employees to the new employer. The employer will enter into negotiations with the new employer in relation to whether the service of affected employees will be treated as continuous and whether they will transfer to the new employer on the same, or better, terms and conditions of employment. As part of these negotiations ONTRACK Infrastructure Limited will put a proposal to the new employer and consider any response received concerning the transfer of affected employees. On the completion of negotiations, employees and their union will be advised as early as possible, but not later than one month prior to the anticipated handover date, the conditions under which the employees can elect to transfer to the new employer and the conditions under which their employment will end if the chose not to transfer or there is no option to transfer. No redundancy compensation shall be payable in any situation where the termination arises (present clause 14.12). Union will obtain legal advice prior to committing to proposed clause.   • Employment Relations The Company is in compliance with all Federal, state or other applicable laws, domestic or foreign, respecting employment and employment practices, terms and conditions of employment and wages and hours, and has not and is not engaged in any unfair labor practice.

  • Employment Relations Education Leave ‌ The Employer shall grant leave on pay for employees party to this MECA to attend courses authorised by NZNO to facilitate the employee’s education and training as employee representatives in the workplace. The numbers of days education leave granted is based on the formula of 35 days per annum for the first 280 full time equivalent employees (employees covered by this MECA who have authorised the NZNO to act on their behalf) and a further five days per annum for every 100 full time equivalent employees thereafter. The full-time Union Representative may also attend these meetings from time to time. The Committee shall meet at the request of either party, for the purpose of discussing matters of mutual concern. Time spent by bargaining unit employees in carrying out the functions of this Committee shall be considered as time worked and shall be paid for by the Co-operative. The Committee shall not have jurisdiction to interpret and/or amend the Collective Agreement.

  • EMPLOYMENT RELATIONSHIPS The ORGANIZATION, its employees, volunteers or agents performing under this Agreement are not deemed to be employees of the COUNTY, nor volunteers or agents of the COUNTY in any manner whatsoever. No officer, employee, volunteer or agent of the ORGANIZATION will hold themselves out as, or claim to be, an officer, employee, volunteer or agent of the COUNTY by reason hereof, nor will they make any claim, demand or application to or for any right or privilege applicable to an officer, employee volunteer or agent of the COUNTY. The parties agree that the COUNTY will not be responsible for the payment of any industrial insurance premiums or related claims or other benefits that may arise during the performance of services under this Agreement for any ORGANIZATION employee or volunteer, or for any consultant’s, contractor’s or subcontractor’s employee(s) or agent(s) that has been retained by the ORGANIZATION.

  • Employment Relationship Employment with the Company is for no specific period of time. Your employment with the Company will be “at will,” meaning that either you or the Company may terminate your employment at any time and for any reason, with or without cause. Any contrary representations that may have been made to you are superseded by this letter agreement. This is the full and complete agreement between you and the Company on this term. Although your job duties, title, compensation and benefits, as well as the Company’s personnel policies and procedures, may change from time to time, the “at will” nature of your employment may only be changed in an express written agreement signed by you and a duly authorized officer of the Company (other than you).

  • Labor Management Relations Section 9.1 Representatives of the Union, not to exceed five (5) in number including at least one (1) representative of each shift, and representatives of the Employer, shall meet at least quarterly at mutually agreed upon times for up to two (2) hours to discuss matters of mutual concern relating to the interpretation, application, or administration of this Agreement and existing work rules which affect the members of the bargaining unit. Each party shall prepare and submit an agenda to the other party one (1) week prior to the scheduled meeting.

  • TRAINING AND EMPLOYEE DEVELOPMENT 9.1 The Employer and the Union recognize the value and benefit of education and training designed to enhance an employee’s ability to perform their job duties. Training and employee development opportunities will be provided to employees in accordance with college/district policies and available resources.
