Description of City Council Action. The Belfast City Council conducted the public hearing and meetings associated with its review of the requested Contract Rezoning Agreement that are required by Chapter 102, Zoning, Article X, Contract Rezoning, Division 3, Residential 1 & 2 zoning districts, Section 102-1404(d). The Council conducted the First Reading of this proposal at its meeting of November 21, 2017, and conducted the Second Reading and public hearing at its meeting of December 5, 2017. The Council, at its meeting of December 5, 2017, found that the Applicant satisfied (OR DID NOT SATISFY) all requirements of Chapter 102, Zoning, Article X, Contract Rezoning, Division 3, Residential 1 & 2 zoning districts, Section 102-1401(b), 102-1404, 102-1405 and 102-1406, and voted at this same meeting to approve the Contract Rezoning Agreement for the property located at Map 11, Lot 167. The Council found that the Applicant proposal satisfied (OR DID NOT SATISFY) all Section 102-1405(a) Mandatory Conditions for a Contract Rezoning Amendment (Agreement) that are stipulated in State Law, all Section 102-1405(b) Discretionary Conditions for a Contract Rezoning Agreement that are stipulated in the City Code of Ordinances, and that the project proposal is consistent with the Goal Statements stipulated in Section 102-1406. The Council authorized (OR DID NOT AUTHORIZE) the City of Belfast City Manager to enter into (sign) this Agreement on their behalf.

Description of City Council Action. The Belfast City Council conducted the public hearing and meetings associated with its review of the requested Contract Rezoning Agreement that are required by Chapter 102, Zoning, Article X, Contract Rezoning, Division 4, Waterfront Mixed Use zoning districts, Section 102-1452. The Council conducted the First Reading of this proposal at its meeting on February 5, 2019. The Council subsequently considered this application at a series of meetings between February and August 2019. The Council conducted the following specific reviews regarding final terms of the Agreement: • The Council conducted the First Reading of the Contract Rezoning Agreement at its meeting of October 1, 2019. The Council also adopted terms of an Agreement (the 10-1-19 Agreement) with the Applicant that resulted in a series of amendments to the Contract Rezoning Agreement. • The Council conducted the Second Reading of the Agreement at its meeting of October 15, 2019 and conducted an associated public hearing. The Council, at its meeting of October 15, adopted the Contract pursuant to the findings identified below. The Council, at its meeting on October 15, 2019, found that the Applicant satisfied all requirements of Chapter 102, Zoning, Article X, Contract Rezoning, Division 4, Waterfront Mixed Use zoning districts, Section 102-1451, 102-1452, and 102-1454, and voted at this same meeting to approve the Contract Rezoning Agreement for the properties located at Map 37, Lot 54 and Map 11, Lot 149. The Council also found that the Applicant proposal satisfied all Section 102-1405(a) Mandatory Conditions for a Contract Rezoning Amendment (Agreement) that are stipulated in State Law, all Section 102-1405(b) Discretionary Conditions for a Contract Rezoning Agreement that are stipulated in the City Code of Ordinances, and that the project proposal is consistent with and satisfied the Goal Statements stipulated in Section 102-1454. The Council authorized the City of Belfast City Manager to enter into (sign) this Agreement on their behalf.
