The adopted Ordinance amendments allow an applicant the opportunity to request to establish most uses that are permitted in the adjacent Downtown Commercial zoning district, subject to Council approval of a contract rezoning agreement. The Applicant has requested a contract rezoning agreement to allow the following uses of the property:  Residential Housing. Applicant intends to retain the existing residence located on the lower floor of the existing building.  Retail Store. Applicant intends to use the upper floor of the building as a retail space for the non-profit organization.  Accessory Uses. The Applicant intends to occasionally operate functions, such as fund-raising events and board meetings, at the building/property that are associated with the non-profit organization.

The Belfast City Council, in October 2014, adopted amendments to the City Code of Ordinances, Chapter 102, Zoning, and Chapter 82, Shoreland, to allow the potential use of contract rezoning for a property located in this zoning and shoreland district. Pursuant to the 2014 Ordinance amendments, reference Chapter 102, Zoning, Article X, Contract Rezoning, Division 4, Waterfront Mixed Use Zoning Districts and Waterfront Development Shoreland District, an applicant whose property is located in the Waterfront Mixed Use 2 zoning district may voluntarily request to apply for a contract rezoning agreement. The Applicant proposal to re-establish the Three Tides Restaurant is a permitted use in both the Waterfront Mixed Use 2 zoning district and the Waterfront Development shoreland district. The main reason the Applicant is pursuing a contract rezoning agreement is because the proposed renovations to the Three Tides Restaurant building result in the Applicant not being able to satisfy dimensional standards for the Waterfront Mixed Use 2 zoning district; both the front structure setback requirement of 10 feet, and the side structure setback requirement of 5 feet (one side of the building). In addition, the Applicant is requesting to construct a small portion of a new stair hall, both the foundation for the stair hall and the overhang of the xxxxx, within the bounds of the City owned right- of-way for the Belfast Harbor Walk.

The applicant intends for both restaurants to have a capacity to seat 100-120 patrons. • Retail. The applicant intends to allow for a small retail space at the restaurant at 00 Xxxxx Xxxxxx and for the majority of the interior space at 0 Xxxxx Xxxxxx to be used for retail, likely by relocating the United Xxxxxx’x Market into the building. • Marina. The applicant intends to significantly expand the marina by eventually offering approximately 70 85 - 90 berths.

Each Authorized User Agreement for Project Based Information Technology Consulting Services will be governed first by the terms and conditions specified in the OGS Centralized Contract and second by terms and conditions added to the Authorized User Mini-Bid. See Appendix B, section 28 regarding modification of Contract terms. Services available under the resultant Contracts will be separated into three (3) distinct Lots.
