This agreement of All Regulatory Authorities shall provide evidence that a decision on the Proposal does not, at this stage, need to be adopted by ACER pursuant to Article 5(7) of the EBGL. However, at the same time the Proposal is not approvable by All Regulatory Authorities. Therefore, this agreement is intended to constitute the basis on which all Regulatory Authorities will each subsequently request an amendment to the Proposal pursuant to Article 6(1) of the EBGL. The most relevant legal provisions that lie at the basis of the ISH Proposal and this All Regulatory Authorities’ agreement on requesting an amendment are Articles 3, 44, 49, 52, 54 and 55 of the EBGL.
