Delivery of Licensed Products. Neither SCEA nor any Designated Manufacturing Facility shall have an obligation to store completed Units of Licensed Products. Publisher may either specify a mode of delivery or allow Designated Manufacturing Facility to select a mode of delivery.

Title, risk of loss, or damage in transit to any and all Licensed Products manufactured by Sony pursuant to Licensee's orders shall vest in Licensee immediately upon delivery to the carrier.

Such orders shall be delivered only to countries within the Territory. Title to the Licensed Products shall vest in accordance with the terms of the applicable letter of credit or, in the absence thereof, per Incoterms 2000.
Delivery of Licensed Products. Upon execution of this Agreement by both parties, GDE shall within thirty (30) days deliver to Vista the Licensed Products. Vista understands and acknowledges that the Licensed Products may have been developed through GDE's independent research and development funds and therefore is provided on an "AS IS" basis. Vista further understands and acknowledges that the ability to use the Licensed Products provided herein may be dependent upon utilizing other third party technology, which is not being provided to Vista by GDE under the terms of this Agreement.

Software may be delivered to Licensee by CD or by remote telecommunications from Emphasys’ place of business unless the parties agree in writing to an alternative method of delivery. Emphasys is not responsible for installing the Software unless Emphasys is specifically contracted to perform installation and training services.

Delivery of Licensed Products. Liquid Audio will communicate a resolution (fix or otherwise) to COMPAQ within three (3) working days after notification of defects in LICENSED SOFTWARE. For all fixed LICENSED SOFTWARE, Liquid Audio will deliver updates to COMPAQ no later than five (5) calendar days after such notification. The foregoing procedure shall be repeated until COMPAQ either accepts the LICENSED SOFTWARE or, at its sole discretion, eliminates the LICENSED SOFTWARE from the current bundle. Elimination from the bundle shall not automatically terminate this agreement.
