COMMISSION WORK. (1) An employee who by agreement with an employer undertakes commission work on a regular basis shall be supplied by the employer, before such work is commenced, with a true copy of the agreement or a statement setting out the terms of the agreement, which shall include -
(a) the wage payable to the employee, which shall not be less than the wage mentioned in clause 4(1) for an employee of his or her category and experience, the rate of the commission and the conditions of entitlement thereto;
(b) the day of the week or month on which commission earned is due and payable;
(c) the type, description, number, quantity or value of sales or orders (individual, weekly, monthly or otherwise) which the employer is from time to time prepared to accept;
(d) the day of payment of commission earned by the employee before termination of the contract of employment: Provided that such day of payment shall be no later than the last work-day of the month succeeding the month during which employment was terminated; and
(e) where applicable, the area in which the employee is required or permitted to work.
(2) Except as provided for in clause 7(4), an employer shall pay an employee at not less than the wage and rate of commission agreed upon between them.
(3) The employee's wage and commission shall be paid on the day stipulated in the agreement referred to in sub-clause (1), and the provisions of clause 5(1) shall not apply in respect of such payment;
(4) An employer shall not require or permit an employee to undertake any work for him or her on the basis of commission only and any amount payable to an employee as commission under an agreement entered into in terms of sub-clause (1) shall be aside from and in addition to the wage stipulated therein.
(5) An employer or an employee who intends to cancel or to negotiate for an alteration of an agreement in regard to commission work shall give written notice of such intention, and the period of such notice shall not be less than nor run concurrently with that required to terminate the contract of employment of such employee in terms of clause 21.
COMMISSION WORK. (1) The basis on which the commission that an employer contracts to pay an employee, in addition to his wage, shall be specified in writing.
(2) When an employer contemplates to change or cancel the basis of the commission stipulated in (1), the employer shall:
(a) Give 4 weeks‟ written notice of his intention to change or cancel the basis of the contract, to a motor vehicle sales person or traveller and if the employee affected is a part salesperson or service supply sales person, the notice period shall be one week.
(b) The written notice shall contain at least the following information:
(i) the reasons for the proposed changes or cancellation;
(ii) the date when the said changes or cancellation are likely to take effect.
(c) Allow the employee/s an opportunity to make representations about any matter dealt within the notification and consider such representation before any change.
COMMISSION WORK. (a) The basis of the commission which an employer contracts to pay a motor vehicle sales person or traveller in addition to his wage shall be specified in writing.
(b) Either party to a contract such as is referred to in paragraph (a) of this sub- clause who intends to cancel or negotiate a change in the basis of the contract shall, after consultation, give four weeks' written notice of such intention to the other party, and no cancellation of or change in the terms of the contract shall be effective unless such notice has been given: Provided that less than four weeks' written notice may be given by the employer if he wishes to increase the rate of commission.
COMMISSION WORK. At , we often have the opportunity to sell commission works. We will offer commissions to our customers unless otherwise told by the artist. If the opportunity or need arises, we will contact the artist to discuss the details of the commission request. will coordinate and manage the process of approval, production status and delivery. The artist is responsible for shipping of the artwork to . will handle all other business costs including but not limited to: shipping to customer, in-home delivery, payment processing, etc.
