Commencement and Construction Requirements. At such time, if at all, as Elements has obtained any necessary authorizations to commence with the Work, the Escrow Closing has occurred, and the Work Permits (as hereinafter defined) have been obtained, then Elements shall proceed with the construction of the Work. Elements shall provide written notice to School Board and Escrow Agent, and Escrow Agent shall release from Escrow and record in the public records the School Board Construction Easement. Elements shall cause its contractor to proceed with the construction of the Work in a professional and xxxxxxx-like manner with commercially reasonable diligence until completion in accordance with the approved Civil Plans and the MOT Plan. The general contractor for the Work shall be a qualified, reputable contractor licensed in the State of Florida and experienced in the type of work which the contractor is to perform, and Elements shall cause its contractor to comply with any and all applicable laws. Elements (or its contractors) shall be responsible for any and all federal, state and local taxes arising from or relating to the performance or completion of the Work, including, without limitation, all federal, state and local unemployment taxes and federal and state income and social security taxes to be withheld from wages. All Work on the Replacement Parcel shall comply with the BSRA Declaration. Elements acknowledges that School Board will require the use of its adjacent property and the parcels which are the subject of this Agreement for parking to serve its adjacent building, and Elements will cause its contractor to make all commercially reasonable efforts to make accommodations for the School Board’s continued parking and access thereto. As set forth below, the Work shall be phased so that the Parking Improvements to the Replacement Parcel are completed and fully functional for School Board’s use prior to any of the Work commencing on the School Board Parcel which impairs School Board’s use of and access to the School Board Parcel. The parties acknowledge and agree that it is necessary throughout the term of this Agreement for the School Board to have full use of the same amount of parking as is existing on the Effective Date, together with full access thereto.

  • Construction Requirements a) All Life and Safety and applicable Building Codes will be strictly enforced (i.e., tempered glass, fire dampers, exit signs, smoke detectors, alarms, etc.). Prior coordination with the Building Manager is required.

  • Commencement and Completion of Construction The Company shall begin Construction Activities no later than January 1, 2014 (“Commencement Date”) and secure a final Certificate of Compliance by June 30, 2015 (hereinafter, “Completion Date”).

  • Design and Construction In complying with the requirements of the specification both with respect to arrangement and detail, design is to conform to the best current engineering practice. Each of the several parts of the material is to be of the maker’s standard design provided that this design is in general accordance with the specification. The essence of design should be simplicity and reliability in order to give long continuous service with high economy and low maintenance cost. Particular attention should be paid to internal and external access in order to facilitate inspection, cleaning and maintenance. The design dimensions and materials of all parts are to be such that they will not suffer damage as a result of stresses under the most severe conditions. Fully detailed specifications of the several parts of the material are to be submitted describing particularly the materials to be used. The materials used in the construction of the material are to be of the highest quality and selected particularly to meet the duties required of them. Mechanisms are to be constructed to avoid sticking due to rust or corrosion. Workmanship and general finish are to be of the highest class throughout. All similar parts of the material are to be interchangeable. All equipment is to operate without undue vibration and with the least possible amount of noise and is not to cause a nuisance. All equipment is to be designed to minimize the risk of fire and any damage, which may be caused in the event of fire. The equipment is also to be designed to prevent ingress of all vermin, accidental contact with live parts and to minimize the ingress of dust and dirt. The use of materials, which may be liable to attack by termites or other insects, is to be avoided.

  • Installation requirements 7.8 We (if we install the System) or our contractor (if we procure a contractor to install the System) must:
