Combination of Occupations. If two or more existing occupations are combined or consolidated, the resulting newly-created occupation shall not be considered to create an increase in the working force or to present an opportunity for recall or promotion under the provisions of Article IX of this agreement, unless and until employees are required for openings in the newly-created occupation in addition to the incumbents of the combined occupations. No such incumbent of one of the combined occupations shall be subject to displacement from the newly-created occupation by senior laid-off employees who held equity or enjoyed recall rights to any other combined occupation prior to the combination. Should the above occur and two (2) or more occupations are combined or consolidated, the higher rate of the existing occupations will apply for the new occupation. When openings occur in the newly-created occupation after the combination, employees on layoff from each of the combined occupations shall be eligible for occupational recall to such openings in accordance with seniority, in accordance with Article IX, Section 9, of this agreement. Incumbent employees of existing occupations which are combined and employees recalled to a newly- created occupation under the occupational recall provisions of Article IX, Section 9, shall be afforded reasonable training in those duties and functions of the newly-created occupation which were not included within the scope of the combined occupation to which they were previously assigned, and no such employee shall be disqualified without an opportunity to acquire the knowledge and familiarity necessary to perform such duties and functions, with a reasonable instruction/training period to demonstrate he can perform the work at an efficient level under normal supervision and instruction. All currently outstanding bids filed under Article IX, Section 11, of the labor agreement on any existing occupation which is combined or consolidated shall be null and void, effective immediately. Employees who continue to desire to express an interest in the duties or functions in question may file a job preference card for the applicable newly-created occupation, subject to the conditions of Article IX, Section 11.

  • Termination of Occupancy Upon termination of occupancy of a County Assisted Unit by a Tenant, such Unit will be deemed to be continuously occupied by a household of the same income level as the initial income level of the vacating Tenant, until such unit is reoccupied, at which time categorization of the Unit will be established based on the occupancy requirements of Section 2.1.

  • DELAY OF OCCUPANCY If the Premises will not be ready for occupancy by Lessee on the Lease Commencement Date, UTA shall give notice thereof to Lessee and indicate the anticipated date possession of the Premises will be delivered to Lessee. In such case, Lessee shall have the right to terminate the Lease upon written notice to UTA within 7 days after delivery of such notice, but not thereafter. If UTA fails to give notice of delay as set forth above and the Premises are not ready for occupancy by Lessee on the Lease Commencement Date, Lessee may terminate this Lease upon written notice to UTA given prior to the date Lessee is notified the Premises are ready for occupancy, but not thereafter. If, in either case, Lessee does not terminate this Lease, (i) the date the Premises are ready for Lessee’s occupancy shall be deemed the new Lease Commencement Date for all purposes; and (ii) UTA shall not be liable to Lessee for any damages arising from the delay in delivery of the Premises to Lessee, provided that Rent shall be abated as to any period prior to delivery of the Premises to Lessee. If Lessee elects to terminate this Lease, Lessee’s sole remedies in such event shall be to obtain a refund of the Deposit and any pre-paid Rent previously delivered to UTA. Notwithstanding any other provision of this section to the contrary, the rights of Lessee under this section shall not be applicable to any cleaning or repair of the Premises that do not materially interfere with Lessee’s occupancy of the Premises on the Lease Commencement Date.

  • Physical/Occupational Therapy This plan covers physical and occupational therapy when: • ordered by a physician; • received from a licensed physical or occupational therapist; • a program is implemented to provide habilitative or rehabilitative services. See Autism Services when physical therapy and occupational therapy services are rendered as part of the treatment of autism spectrum disorder. The amount you pay and any benefit limit will be the same whether the services are provided for habilitative or rehabilitative purposes.

  • NUMBER OF OCCUPANTS Tenant agrees that the House shall be occupied by no more than [Total Number of Occupants] persons, including no more than [Maximum Number of Children] under the age of eighteen (18) years, without the prior written consent of Landlord.

  • Period of Occupancy The student may occupy an assigned room at the time specified by the university each semester. If the student fails to occupy the room by 5:00 p.m. on the first day of classes, the university reserves the right to reassign the space or initiate a contract cancellation. However, failure to occupy an assigned space does not automatically release the student from contractual obligation. Occupancy of the room must be relinquished at the completion of the contract. University housing facilities are closed during the periods between semesters, the Thanksgiving holiday and spring break.   • Conditions of Occupancy The Resident may not occupy a Room, unless (i) the Resident is currently enrolled and maintaining status as a full- time student in good standing at the Institution; (ii) this Agreement is executed by all parties; (iii) all Residence Fees then due and payable are paid in full as stated in section 2.03; (iv) the Manager has designated a Room for the Resident and (v) the Resident meets any additional conditions to occupancy established by the Institution, including any vaccination conditions.

  • Right of Occupancy Provider will provide Resident with a space in the Residence Facility for his/her occupancy as a residence. The right of occupancy does not include the right to a specific residence space, roommate, or type of accommodation by this Agreement. University will make housing assignments on behalf of Provider subject to availability of space and without regard to race, religion, color, age, disability, national origin, or sexual orientation. Final determinations on housing assignments are in the sole discretion of University acting on behalf of Provider. No guarantee of a specific unit space assignment is implied or made.

  • PARTIAL OCCUPANCY OR USE § 9.9.1 The Owner may occupy or use any completed or partially completed portion of the Work at any stage when such portion is designated by separate agreement with the Design-Builder, provided such occupancy or use is consented to, by endorsement or otherwise, by the insurer providing property insurance and authorized by public authorities having jurisdiction over the Project. Such partial occupancy or use may commence whether or not the portion is substantially complete, provided the Owner and Design-Builder have accepted in writing the responsibilities assigned to each of them for payments, retainage, if any, security, maintenance, heat, utilities, damage to the Work and insurance, and have agreed in writing concerning the period for correction of the Work and commencement of warranties required by the Design-Build Documents. When the Design-Builder considers a portion substantially complete, the Design-Builder shall prepare and submit a list to the Owner as provided under Section 9.8.2. Consent of the Design-Builder to partial occupancy or use shall not be unreasonably withheld. The stage of the progress of the Work shall be determined by written agreement between the Owner and Design-Builder.

  • Certificate of Occupancy The Contractor’s obligation under the Contract is to install the Work in accordance with the Contract Documents, obtain the Certificate of Occupancy from the State Fire Marshal or his deputy, and forward it to the Design Professional as a part of the final close out procedures. The Design Professional’s obligation is to design the Work to comply with the applicable codes and to qualify for a Certificate of Occupancy.

  • POSSESSION AND OCCUPATION 12.1 The Purchaser shall be placed in possession of the Property on the Transfer Date or the Occupation Date, whichever is the earlier, from which date the Purchaser will be entitled to all income and be liable for all expenses pertaining to the Property.
