BUSINESS DAY AND FUNDS AVAILABILITY DISCLOSURE. You understand and agree that, for purposes of deposits made using the Service: • Accounts opened 60 days or greater: On a daily basis, $300 of your deposits made that day shall be immediately available for withdrawal from your Account subject to the terms of this Disclosure and Agreement. The earliest that funds in excess of $300 a day via the Service, will be available for withdrawal or to pay checks that you have written would be the fourth business day after the business day on which the deposit is received. • Accounts opened for less than 60 days or for Primary Members under 18 years of age: No funds are immediately available. Funds will be available the fourth business day after the business day on which the deposit is received. • For determining the availability of a deposit, every day is a business day except Saturdays, Sundays, and federal holidays. If you make a deposit via this Service on a business day during business hours, we will consider that day to be the day of your deposit. However, if you make a deposit via this Service on a day that is not a business day or after our business hours, we will consider that the deposit was made on the next business day that we are open. • Check holds or unavailability of the Service may cause further delays in availability of funds beyond that time. Checks deposited via the Service do not fall under the regulatory provisions of Regulation CC - Expedited Funds Availability Act. As such, longer hold periods may apply to these deposited items. LONGER DELAYS MAY APPLY You understand that funds deposited via the Service, while generally available by the fourth business day after we receive them, may be delayed for a longer period under the following circumstances: • We believe a check you have deposited will not be paid. • You deposit checks totaling more than $5,000 on any one day via Mobile Check Deposit, a branch, an ATM, or a combination thereof. • You re-deposit a check that has been returned unpaid. • Your Account has been overdrawn repeatedly in the last six months. • There is an emergency, such as failure of computer or communications equipment. You understand that funds availability may be delayed, that we will notify you if we delay your ability to withdraw funds for any of these reasons, and that we will tell you when the funds will be available.
BUSINESS DAY AND FUNDS AVAILABILITY DISCLOSURE. If an image you transmit through the Service is received and accepted before 4:00 p.m. Eastern Time on a business day that we are open, we consider that day to be the day of your deposit. Otherwise, we will consider that the deposit was made on the next business day we are open. For determining the availability of a deposit, every day is a business day except Saturdays, Sundays, and federal holidays. You agree, however, that items transmitted through the Service are not subject to the funds availability requirements set forth in the “Funds Availability Policy and Disclosure” section of the Credit Union’s Deposit Agreement or Regulation CC of the Federal Reserve Board. We reserve the right to delay availability up to 30 days from the date we receive payment for items transmitted through the Service.

Funds from the following deposits are available on the first (1st) business day after the day of your deposit: • U.S. Treasury checks that are payable to you. • Wire transfers. • Checks drawn on us. If you make the deposit in person to one of our employees, funds from the following deposits are also available on the first (1st) business day after the day of your deposit: • Cash. • State and local government checks that are payable to you. • Cashier’s, certified, and xxxxxx’s checks that are payable to you. • Federal Reserve Bank checks, Federal Home Loan Bank checks, and postal money orders, if these items are payable to you. If you do not make your deposit in person to one of our employees (for example, if you mail the deposit), funds from these deposits will be available on the second (2nd) business day after the day we receive your deposit.

  • RDDS availability Refers to the ability of all the RDDS services for the TLD, to respond to queries from an Internet user with appropriate data from the relevant Registry System. If 51% or more of the RDDS testing probes see any of the RDDS services as unavailable during a given time, the RDDS will be considered unavailable.

  • Subject to Funds Availability The Contract is subject to the appropriation and availability of State and/or Federal funds. In the event that the funds are not appropriated or are otherwise unavailable, the Institution reserves the right to terminate the Contract upon written notice to the Contractor. Termination under this Section E.2 shall not be deemed a breach of Contract by the Institution. Upon receipt of the written notice, the Contractor shall cease all work associated with the Contract. Should such an event occur, the Contractor shall be entitled to compensation for all satisfactory and authorized services completed as of the termination date. Upon such termination, the Contractor shall have no right to recover from the Institution any actual, general, special, incidental, consequential, or any other damages whatsoever of any description or amount.

  • Funding Availability This Contract is at all times subject to state appropriations. The Department makes no express or implied representation or guarantee of continued or future funding under this Contract. The Department has, as of the date of the execution of this Contract, obtained all requisite approvals and authority to enter into and perform its obligations under this Contract, including, without limitation, the obligation to make the initial payment or payments required to be made under this Contract on the date or dates upon which such initial payment or payments may otherwise be disbursed during the current contract period, (i.e., Sept ember 1, 2015, through August 31, 2017). The Grantee acknowledges the Department’s authority to make such payments is contingent upon the Texas Legislature's appropriation to the Department of sufficient funds and the availability of funds to the Department for such purpose. If the State of Texas or the federal government terminates its appropriation through the Department or fails to pay the full amount of the allocation for the operation of any grant or reimbursement program hereunder , or the funds are otherwise unavailable, the Department may immediately and without penalty reduce payments or terminate this Contract, in whole or in part. Upon termination of the Contract or reduction of payments, the Grantee shall return to the Department any unexpended funds already disbursed to the Grantee. Neither the Department nor the State of Texas shall incur liability for damages or any loss that may be caused or associated with such termination or reduction of payments. The Department shall not be required to give prior notice for termination or reduction of payments.

  • Same-Day Availability Funds received from preauthorized electronic payments such as payroll direct deposits, or other preauthorized electronic payments will be available on the day the deposit is applied to your Account. ACH Credits received from an external bank account will be applied to the Account when we have verified the external account and received payment on collected funds. Once the funds are applied to the Account, they will have same day availability.

  • Non-Availability of Funds Every payment obligation of the State under this Charter is conditioned upon the availability of funds continuing to be appropriated or allocated for the payment of such obligations. If funds are not allocated and available for the continuance of this Charter, the Commission may terminate this Charter at the end of the period for which funds are available. No liability shall accrue to the Commission, nor the State, or any of its subdivisions, departments or divisions, in the event this provision is exercised, and neither the Commission nor the State shall be obligated or liable for any future payments or for any damages as a result of termination under this paragraph.

  • Amount of Funds Available to Grantee The maximum amount of funding being made available to Grantee under this Agreement is: $20,000. This amount may be amended, subject to funds availability, by mutual consent of the parties. Grant funds under this Agreement may be considered taxable income.

  • Product Availability Under no circumstances shall Company be responsible to Representative or anyone else for its failure to fill accepted orders, or for its delay in filling accepted orders, when such failure or delay is due to strike, accident, labor trouble, acts of nature, freight embargo, war, civil disturbance, vendor problems or any cause beyond Company's reasonable control.

  • Fund Availability Financial obligations of the University payable after the current Fiscal Year are contingent upon funds for that purpose being appropriated, budgeted, and otherwise made available.
