Availability of Funds means that the funds on a payment account may be used by the payment service user without fees being charged;

Availability of Funds. This Agreement is contingent upon the receipt of funds and continued authorization for program activities. In the event that such funds become unavailable for any reason or authorization for program activities is withdrawn or otherwise modified, COMMCORP has the unilateral right and absolute discretion to modify or terminate this Agreement at any time.

Availability of Funds. DISTRICT’s obligations under this Contract are contingent upon the availability of Mitigation Trust funds. In the event such funds are not available, DISTRICT will have no liability to pay any funds whatsoever to the CONTRACTOR or to furnish any other considerations under this Contract.
