Seller Competing Business definition

Seller Competing Business means any enterprise that engages in, owns or operates businesses that provide facility-based or online tutoring services or tutoring services provided under contract with a Governmental Entity in the United States, in each case, for grades K-12 and younger students (other than any business conducted pursuant to the Master License Agreement) and any enterprise that owns or operates government funded "charter schools" as such term is defined under applicable law in effect on the date hereof.
Seller Competing Business has the meaning set forth in SECTION 7.9(B).
Seller Competing Business means the design, development, engineering, manufacture, sale or distribution of communications devices including, but not limited to, communications gateways, bridges, call processing servers or other communication devices which incorporate any form of voice, video or data communications capabilities, and that enable communications across and between different types of networks and end-points. Notwithstanding the foregoing, Seller Competing Business shall not include the design, engineering, manufacture, sale or distribution of Network Access Devices.
