Pre-Existing Contamination definition

Pre-Existing Contamination means Hazardous Materials (i) present in concentrations that exceed action levels which trigger a duty to investigate or respond as established under Environmental Law to protect human health and safety, (ii) located at the Site or the Off-Site Rights of Way and Easements, and (iii) that pre-date Contractor’s and its Subcontractors’ and Sub-subcontractors’ commencement of any Work under this Agreement, excluding any Hazardous Materials which Contractor is responsible for under the Stage 1 EPC Agreement.
Pre-Existing Contamination means the presence on or before the Closing Date of any Hazardous Materials in the soil, groundwater, surface water, air or building materials of any Media Business Facility which results from Pre-Closing Hazardous Materials Activities or for which the Company has contractually assumed liability.
Pre-Existing Contamination means any Hazardous Materials, coal combustion byproducts or construction and demolition waste or other solid waste present on, at or under the Site that was introduced before the Effective Date.

More Definitions of Pre-Existing Contamination

Pre-Existing Contamination shall have the meaning ascribed to such term in Section 1.43.
Pre-Existing Contamination means any Hazardous Material present in any environmental medium as a result of a Release at the Linden Wind Energy Project Site prior to the commencement of the Services and not arising from or relating to the activities of BOP Contractor or any of its Subcontractors.

Pre-Existing Contamination means any pollution, contamination, environmental hazard or other environmental degradation in existence in, on or under the Airport Lands or in any building or structure in, on or under the Airport Lands as at the date of the Agreement.
Pre-Existing Contamination means any Environmental Condition which exists at the Facility as of the Commencement Date , whether known or unknown, or whenever discovered.
