Environmental Contamination definition

Environmental Contamination means the introduction or presence of Hazardous Materials at such levels, quantities or location, or of such form or character, as to constitute a violation of federal, state or local laws or regulations, and present a material risk under federal, state or local laws and regulations that the Premises will not be available or usable for the purposes contemplated by this Agreement.

Environmental Contamination means each of the following and their consequences:

Environmental Contamination means the release of a hazardous substance, or the potential release of a discarded hazardous substance, in a quantity which is or may become injurious to the environment or to the public health, safety, or welfare.

• Nothing stated herein is intended to limit the right of the Landlord or the Postal Service to make claims for contribution or cost recovery under applicable laws against each other or any other persons or entities responsible for such Environmental Contamination.

• The Grantor, for itself, its successors and assigns, shall provide to the Distributor any information within its possession or control about past and currently existing Environmental Contamination in the Easement.

• NPO shall not allow any "Environmental Contamination" (defined in Section [26 ] (INDEMNIFICATION)) below to be released onto the Premises by itself or its agents, contractors, invitees, or licensees, and NPO shall clean-up said releases if they occur.

More Definitions of Environmental Contamination

Environmental Contamination means petroleum products (including oil, gasoline, and kerosene), hazardous wastes, hazardous substances, hazardous materials, toxic substances, toxic wastes, hazardous air pollutants, and toxic pollutants, as those terms are used in any federal, state, or local laws, rules, regulations, codes, and ordinances, as amended from time to time. "Indemnitees" means Landlord and its officers, officials, independent contractors, agents, and employees, and does not include NPO. (c)

Environmental Contamination means pollution resulting from the “release” [as that term is defined in AS 46.03.826(9)] of a “Hazardous Material.”

Environmental Contamination means any hazardous material or hazardous waste as defined in 10 V.S.A. § 6602, or other substance or material that has the potential to adversely affect human health or the environment (A) on or in an affected property, including in buildings or other structures, or (B) on or in a natural resource.

Environmental Contamination means any actual or threatened release, spill, emission, leaking, pumping, injection, presence, deposit, abandonment, disposal, discharge, dispersal, leaching or migration into the indoor or outdoor environment, or into or out of any of the Equipment, including, without limitation, the movement of any Hazardous Substance or other substance through or in the air, soil, surface water, groundwater or property.

Environmental Contamination means any discharge, release, spillage, leakage, escape, deposit, presence, storage, accumulation or disposal of any Hazardous Substances at, on, or under the Relevant Property or any emanation or migration including (for the avoidance of doubt) as the result of piped discharge of Hazardous Substances from any of the Relevant Property whether at any past, present or future time;

Environmental Contamination means the presence within the Easement of any hazardous material, including, but not limited to, any substances defined as or included in the definition of “hazardous substance,” “hazardous material” or “toxic substances” in the Comprehensive Environmental Response, Compensation, and Liability Act, 42 U.S.C. § 9601, et seq., the Hazardous Materials Transportation Act, 49 U.S.C. § 5101, et seq., the Resource Conservation and Recovery Act, 42 U.S.C. § 6901, et seq., or any other federal, state or local statute, law, ordinance, code, rule, regulation, order, decree or other requirement of governmental authority regulating, relating to or imposing liability or standard of conduct concerning any hazardous, toxic or dangerous substance or material, as now or at any time hereafter in effect, and in the regulations adopted, published, and/or promulgated pursuant to said laws.

Environmental Contamination means the introduction or presence of Hazardous Materials at such levels, quantities or location, or of such form or character, as to constitute a violation of federal, state or local laws or regulations, and present a material risk under federal, state or local laws and regulations that a Site will not be available or usable, whether in whole or in part, for the purposes contemplated by this PP A.
