Plan of Notice definition

Plan of Notice means the plan for disseminating the First Notice and the Second Notice to the Class, as approved by the Court, which shall substantially be in accordance with the plan attached as Schedule “C”.
Plan of Notice means the plan for distributing the Notice to Class Members.
Plan of Notice means the following procedures for providing Notice of Settlement to the members of the Settlement Class. Within ten (10) business days after entry of the Preliminary Approval Order, the Settlement Administrator will (a) send the Notice of Settlement, Exhibit D, by mail to the putative members of the Settlement Class for whom a mailing address can be found in Defendant’s current electronic database containing last-known addresses of royalty payees, that Defendant will provide for implementation of this Agreement; and (b) publish the Notice of Settlement, Exhibit E, in (i) The Daily Ardmoriete, (ii) Fairview Republican, (iii) Hughes County Tribune, (iv) McAlester News-Capital, (v) The Oklahoman, (vi) Tulsa World, (vii) Clinton Daily News, and (viii) Elk City Daily News. The Settlement Administrator shall provide Settlement Class Counsel with a spreadsheet identifying by royalty owner number, name, complete mailing address, and email address(es), each member of the Settlement Class to whom the Notice of Settlement is mailed or otherwise provided.

  • Forthwith after the publication and dissemination of each of the notices required by this section, Class Counsel shall file with the Court affidavits confirming that the notices have been published and disseminated in accordance with the Agreement and the Plan of Notice, as appropriate, or order of the Court.

  • Class Counsel shall cause the First Notice to be published and disseminated in accordance with the Plan of Notice and the costs of doing so shall be paid as a Non-Refundable Expense as provided in section 4.1(1)(b) of this Agreement.


More Definitions of Plan of Notice

Plan of Notice means the plan for disseminating the First Notice and Second Notice to the Class, in a form satisfactory to the Plaintiff and the Defendants, all acting reasonably.
Plan of Notice means the following procedures for providing Notice of Settlement to the members of the Settlement Class. Within (10) ten business days after entry of the Preliminary Approval Order, the Settlement Administrator will (a) send the Notice of Settlement, Exhibit D-1, by mail to the putative members of the Settlement Class for whom a mailing address can be found in Defendants’ current electronic databases containing last known addresses of royalty payees, that Defendants will provide for implementation of this Agreement and (b) publish the Notice of Settlement, Exhibit D-2,

The cost of such mailed and published notice shall be an Administration Expense. The requirements of the Class Action Fairness Act for giving certain governmental officials notice of this proposed settlement, and allowing such officials a specified amount of time within which to object to or otherwise comment on the proposed settlement, shall be complied with before the Settlement Fairness Hearing.
