Executive hereby forever waives and releases the Company and its directors, officers, employees, and agents from any and all claims, actions, damages, losses, costs, expenses, and liability of any kind, arising under any legal or equitable theory whatsoever at any time during or after the period of his employment by the Company, arising directly or indirectly from the Company’s and its agents’, representatives’, and licensees’ exercise of their rights in connection with any Permitted Uses.
During the term designated on any Order Form or Schedule, PERFORMIVE grants to Customer the right and non- exclusive license (“License”) to use the Customer Space identified in the Order Form solely for the Permitted Uses (as defined below).
The Premises shall be used and occupied by Tenant solely for the Permitted Uses and for no other purpose.
Unless otherwise agreed by PERFORMIVE in writing, Customer shall perform the Permitted Uses at its sole cost and expense.
