Path Usage definition

Path Usage means a right granted under this agreement to the Access Holder to utilise a Train Path through the operation of a Service by a nominated Operator on the Train Path; Period means a Month or a Quarter; Pricing Zone means the grouping of segments as published by ARTC on its website from time to time which must be in accordance with the Access Undertaking; PWCS means Port Waratah Coal Services Limited, (ABN: 99 001 363 828); Quarter means a calendar quarter commencing on each of 1 January, 1 April, 1 July and 1 October;
Path Usage means the right granted under the Access Holder Agreement to utilise a Train Path through the operation of a Service by a nominated Operator on the Train Path and for which the Access Holder has nominated the Operator to operate that Service;
Path Usage means a right granted under this agreement to the Access Holder to utilise a Train Path through the operation of a Service by a nominated Operator on the Train Path; Period means a Month or a Quarter;

Examples of Path Usage in a sentence

  • The Access Holder acknowledges that an Operator may agree to temporary variations to, and cancellations of, a Path Usage in accordance with the Operator Sub-Agreement without the ARTC or Operator notifying the Access Holder.

  • The Access Holder must pay the Charges for each Train Path and each Path Usage as set out or determined under Schedule 3 and in accordance with this clause 5.

  • Notwithstanding any other clause of this agreement, ARTC is not responsible for any loss, additional cost or other damage suffered by the Operator in the event that a Train Path or a Path Usage or any part of it is not available or that an Operator’s Train will not be delivered on time to its ultimate or intermediate destination if such unavailability or failure to deliver occurred by reason of any of the matters described in clause 3.1(b) and without material breach of this agreement by ARTC.

  • Subject to clause 3.1(a), the Operator’s right to operate a Service on a Train Path or a Path Usage does not give the Operator an exclusive right to any Train Path or Path Usage.

  • The Access Holder must pay the Charges for each Train Path and each Path Usage as set out or determined under Schedule 33 and in accordance with this clause 5.

  • Path is not exclusive Subject to clause 3.1(a), the Operator’s right to operate a Service on a Train Path or a Path Usage does not give the Operator an exclusive right to any Train Path or Path Usage.

  • For each Ad Hoc Path Usage, and each Path Usage which is agreed by ARTC and the Access Holder to be provided on an ad-hoc basis, the Access Holder must pay a Charge (“Ad Hoc Charge”) equal to the TOP Price PZ for each Pricing Zone spanned by the Train Path (in addition to the Non-TOP Charge).

  • To avoid doubt, where a Path Usage is removed from the Base Path Usages, a corresponding Path Usage will be deleted from the Access Holder’s Annual Contracted Path Usages in the relevant Train Path Schedule for the relevant Contract Year.

  • For each Ad Hoc Path Usage, and each Path Usage which is agreed by ARTC and the Access Holder to be provided on an ad-hoc basis, the Access Holder must pay a Charge (“Ad Hoc Charge”) equal to the TOP Price PZ for each Pricing Zone spanned by the Train Path (in addition to the Non-TOP Charge) as follows:.

  • The Operator’s right to use a Train Path or a Path Usage under clause 3.1 exclude any rights to access the Network for the purpose of the Operator’s light engine movements other than through ad hoc entitlements as referred to in subsection (b) of the definition of “Train Paths”.

Related to Path Usage

  • Facility Usage means, at the time in question, the aggregate amount of outstanding Loans and LC Obligations at such time.

  • Revolver Usage means, as of any date of determination, the sum of (a) the amount of outstanding Advances, plus (b) the amount of the Letter of Credit Usage.

  • Aggregate Revolver Outstandings means, at any date of determination: the sum of (a) the unpaid balance of Revolving Loans, (b) the aggregate amount of Pending Revolving Loans, (c) one hundred percent (100%) of the aggregate undrawn face amount of all outstanding Letters of Credit, and (d) the aggregate amount of any unpaid reimbursement obligations in respect of Letters of Credit.

  • Average Revolver Usage means, with respect to any period, the sum of the aggregate amount of Revolver Usage for each day in such period (calculated as of the end of each respective day) divided by the number of days in such period.

  • Required Availability means Excess Availability and unrestricted cash and Cash Equivalents in an amount of not less than $5,000,000.

  • Revolving Facility Usage means at any time the sum of the outstanding Revolving Credit Loans, the outstanding Swing Loans, and the Letter of Credit Obligations.

  • Canadian Availability means, at any time, an amount equal to (a) the lesser of (i) the aggregate Canadian Revolving Commitments at such time and (ii) the Canadian Borrowing Base at such time, minus (b) Commitment Reserves established with respect to the Canadian Loan Parties and/or the Canadian Collateral at such time minus (c) the Aggregate Canadian Credit Exposure at such time.

  • Availability Block means $15,000,000.

  • Revolving Availability means Class A Revolving Availability or Class B Revolving Availability, as applicable.

  • Non-Availability Charges has the meaning set forth in the CAISO Tariff.

  • Letter of Credit Usage means, as at any date of determination, the sum of (i) the maximum aggregate amount which is or at any time thereafter may become available for drawing under all Letters of Credit then outstanding plus (ii) the aggregate amount of all drawings under Letters of Credit honored by Issuing Lenders and not theretofore reimbursed out of the proceeds of Revolving Loans pursuant to subsection 3.3B or otherwise reimbursed by Company.

  • Maximum Availability has the meaning set forth in Section 2.1.1.

  • Maximum Credit means, at any time, (a) the lesser of (i) the Revolving Credit Commitments in effect at such time and (ii) the Borrowing Base at such time minus (b) the aggregate amount of any Availability Reserve in effect at such time.

  • Total Revolving Outstandings means the aggregate Outstanding Amount of all Revolving Loans, all Swing Line Loans and all L/C Obligations.

  • Line Cap means, as of any date of determination, the lesser of (a) the Maximum Revolver Amount, and (b) the Borrowing Base as of such date of determination.

  • Non-Usage Fee The meaning set forth in the applicable Fee Letter.

  • System Availability means, with respect to any particular calendar month, the ratio obtained by subtracting Unscheduled Downtime during such month from the Total Monthly Time, and thereafter dividing the difference so obtained by the Total Monthly Time. Represented algebraically, System Availability for any particular calendar month is determined as follows:

  • Network Availability means the capability of the equipment to resume functions after a remotely initiated trigger has been detected by a network port;

  • Undrawn Availability at a particular date shall mean an amount equal to (a) the lesser of (i) the Formula Amount, or (ii) the Maximum Revolving Advance Amount, minus the Maximum Undrawn Amount of all Letters of Credit, minus (b) the sum of (i) the outstanding amount of Revolving Advances, plus (ii) amounts due and owing to any Borrower’s trade creditors which are outstanding sixty (60) days or more past the due date thereof.

  • Loan Limit means, at any time, the lesser of (a) the Total Commitment at such time and (b) the Borrowing Base at such time (including as it may be reduced pursuant to Section 2.14(h)).

  • Borrowing Availability means, as of any date of determination, the lesser of (i) the Maximum Amount and (ii) the Borrowing Base, in each case, less the sum of the aggregate Revolving Loan and Swing Line Loan then outstanding.

  • Revolving Credit Availability means, at any particular time, the amount by which (x) the Aggregate Revolving Loan Commitment at such time exceeds (y) the Dollar Amount of the Revolving Credit Obligations outstanding at such time.

  • Maximum Credit Amount means, as to each Lender, the amount set forth opposite such Lender’s name on Annex I under the caption “Maximum Credit Amounts”, as the same may be (a) reduced or terminated from time to time in connection with a reduction or termination of the Aggregate Maximum Credit Amounts pursuant to Section 2.06(b) or (b) modified from time to time pursuant to any assignment permitted by Section 12.04(b).

  • Aggregate Maximum Credit Amounts at any time shall equal the sum of the Maximum Credit Amounts, as the same may be reduced or terminated pursuant to Section 2.06.

  • Swing Line Availability has the meaning ascribed to it in Section 1.1(c)(i).

  • emission limit value means the mass, expressed in terms of certain specific parameters, concentration and/or level of an emission, which may not be exceeded during one or more periods of time;
